Under authority of the State laws of Missouri, Section 305.210, RSMo., there is hereby created an Airport Board in the City of Albany, Missouri. The Board shall consist of six (6) members who shall be appointed by the Mayor, subject to the consent of the Board of Aldermen. Directors appointed to the Airport Board must be citizens of the City of Albany, Missouri. No member of the Municipal Government shall be a member of said Board. At least two (2) members of the Airport Board shall be persons who have held or at present hold a Department of Transportation pilot's license or military pilot's rating.

A. 
Such members shall hold their respective office from the first (1st) of July following their appointment. They shall be appointed for a term of three (3) years, except that those initially appointed, at the first (1st) meeting, shall cast lots for their respective terms, two (2) Directors, to serve one (1) year, two (2) Directors to serve two (2) years, and two (2) Directors to serve three (3) years. Annually and thereafter on or before the first (1st) meeting in July, the Mayor shall, by and with the consent of the Board of Aldermen, appoint two (2) Directors, who shall hold office for three (3) years.
B. 
The Mayor may, by and with the consent of a two-thirds (⅔) vote of the Board of Aldermen, remove any member of the Airport Board.
C. 
The City Administrator or his appointed staff representative shall be a non-voting ex-officio member of the Board.
D. 
Vacancies occasioned by removal, resignation or otherwise shall be filled in like manner as original appointments, except that the term of the office is restricted to the unexpired term of office. No Director of the Board shall receive compensation.

A. 
The Airport Board shall, each July, immediately after the appointment of Directors, meet and organize by the election of one (1) member as President, one (1) as Vice-President, and one (1) as secretary.
B. 
The Board shall meet in regular public sessions at City Hall on the fourth (4th) Monday of each month and at such other times as necessary. Special meetings may be called by the President upon notice to the other Board members and upon compliance with those State Statutes governing notice to the public. Minutes of each meeting shall be kept and maintained as a permanent record, and a copy thereof shall be filed with the City Clerk within ten (10) days of any meeting.
C. 
Four (4) members shall constitute a quorum for the transaction of business at any regular or special meeting of the Board; any action by the Board shall be based on a majority vote of all members of the Board.

A. 
The Airport Board shall:
1. 
Survey and make plans for the development and maintenance of the Albany Municipal Airport.
2. 
Have exclusive control of the budgeted expenditures of all money collected to the credit of the Airport Fund, for the supervision, improvement, care, acquisition and custody of the Airport.
3. 
Deposit all monies received for the Airport Fund in the Treasury of Albany, Missouri, to the credit of the Airport Fund. Such funds shall be kept separate and apart from all other monies and accounts of the City of Albany, Missouri, and shall be drawn upon by the proper officers of the City of Albany, Missouri, upon the properly authenticated purchase order of the Airport Board.
4. 
Be authorized to employ a manager for the Municipal Airport, and such other employees as may be necessary; the Board may discharge the manager or other employees as deemed necessary within its discretion.
5. 
Not later than April of each year, formulate a proposed budget for the next Municipal fiscal year, to be presented to the City Administrator for review and consideration as a part of the overall City budget.

A. 
The Board shall make and adopt such by-laws, rules and regulations for its own guidance and proceedings as may be expedient but the same shall not be inconsistent with provisions of this Chapter and with the laws of the State of Missouri. The following policies, rules and regulations are specifically required:
1. 
Permit required for commercial use of airport. Every person, firm or corporation operating aircraft from the Albany Municipal Airport for hire or for profit and who shall engage in any commercial pursuit thereon, shall first procure a permit from the Airport Board which said permit shall be issued by the Board upon approval by said Board based upon application therefore duly made out by any such person, firm or corporation upon blanks furnished by said Airport Board.
2. 
Insurance requirements. Any such commercial user shall, upon request of the Airport Board, file with the said Board a copy of liability insurance covering said operator and his aircraft. Such liability insurance shall cover public liability and property damage as may be required by the Airport Board.
3. 
Financial statement may be required. All persons, firms or corporations, using said Airport as a fixed base of operation shall file a financial statement with the Airport Board as the same may be requested by said Board from time to time.
4. 
Spraying and dusting operations. Aerial spraying or crop dusting operations shall be permitted to operate out of Albany Municipal Airport, subject to requirements of this Chapter and rules and regulations as propounded by the Airport Board.
5. 
Charter use. A permit shall be required by each commercial user of a plane by a fixed base operator but no charge shall be made for charter use, whether hauling passengers or freight. However any person, firm or corporation using a plane for such charter use shall procure insurance as provided in Subsection (2) hereof.
6. 
Fees payable — when. Any fee to be charged hereunder, shall be paid in advance by the applicant, and upon failure or refusal to pay any such fee or fees or a refusal or failure to comply with the rules and regulations and orders of the Airport Board and for violations of this Chapter the use of said Airport to such applicant or permittee may be denied. The Airport Board shall reserve the right to cancel or revoke any permits so issued by it to any user of said Airport for cause.
7. 
Private aircraft. Nothing in these rules and regulations shall be construed to prevent the use of the Airport by private planes operating without profit.
8. 
Vehicles on runways, etc. No person shall operate or drive any vehicle, (other than airplanes) farm implements, machinery, team or livestock across, upon, over or along the runways or taxi strips located on the Albany Municipal Airport.
9. 
Litter on runways. No person shall place any object or leave any object, other than airplanes, on the runways or taxi strips located on the Albany Municipal Airport.
10. 
Standing on runways. No person shall stand upon or lie down upon the runways or taxi strips located on the Albany Municipal Airport.
11. 
Joyriding near runways. No person shall enter upon, go across, or travel on or along the runways or taxi strips now located on the Albany Municipal Airport when an airplane is landing upon or about to land upon or is about to leave the Albany Municipal Airport.
12. 
Penalty. Violations of Subsections (8, 9, 10, and 11) shall be deemed a misdemeanor, punishable by a fine of not less than five hundred dollars ($500.00) or ninety (90) days in the City Jail, or by both such fine and imprisonment.

A. 
The President of the Airport Board shall present to the Board of Aldermen an annual report. Such report shall be presented at the first (1st) Board meeting in June of each year and shall consist of:
1. 
The condition of their trust as of the first (1st) day of June of that year.
2. 
The various sums of money received from the Airport Fund, and other sources.
3. 
The sums of money expended by the Board and for what purposes.
4. 
Such other statistics, information and suggestions as the Board may deem to be of general interest.
5. 
Recommendations for improving the Airport facilities.
6. 
An annual planned program for the use and development of the Airport facilities.
7. 
All such portion of said report as related to the receipts and expenditures of money shall be verified by affidavits.

All contracts negotiated by the Airport Board shall be executed by the Mayor and City Clerk, upon approval of the Board of Aldermen.

The Airport Board shall receive such funding as the Board of Aldermen shall designate.

The Airport Board shall be held as special trustees for all donations of money, personal property or real estate for the benefit of the Albany Municipal Airport, whenever such donations are accepted according to the terms of the deed, gift, devise or bequest of such property. Any such donation shall be received and accounted for through the City Clerk and shall be held as designated funds specifically for Airport Board designated use.
