For the purposes of this Chapter the following terms shall have
the prescribed meanings:
A park, reservation, playground, swimming pool, recreation
center, community building or any other area in the City, owned or
used by the City, and devoted to active or passive recreation. A "park" as defined herein includes any real estate designated
in the Zoning Map of the City of Albany for park purposes and all
facilities located on any such real estate.
Any person, firm, partnership, association, company, corporation
or organization of any kind.

A.
All
parks in the City shall open at 6:30 A.M. and close at 10:30 P.M.
and no person shall be on, or remain on or in, any park during said
closed hours of the park.
B.
Exception. In the event any athletic event, meeting, swimming
pool usage or other event, which has been scheduled with the proper
Park Board authority, extends beyond 10:30 P.M., then the park facility
in use for such event shall be closed thirty (30) minutes after the
conclusion or adjournment of said event.

A.
Officials. Any Law Enforcement Officer of this City, any
Park Board employee or Park Board member shall, in connection with
their duties imposed by law, diligently enforce the provisions of
this Chapter.
B.
Ejectment. Any Law Enforcement Officer of this City, any
Park Board employee or Park Board member shall have the authority
to eject from the park any person acting in violation of this Chapter.

Any person violating any of the provisions of this Chapter shall
be deemed guilty of a misdemeanor and upon conviction thereof shall
be fined in an amount not exceeding five hundred dollars ($500.00)
or be imprisoned in the City Jail for a period not exceeding ninety
(90) days or be both so fined and imprisoned. Each day such violation
is committed or permitted to continue, shall constitute a separate
offense and shall be punishable as such hereunder.
