All other provisions of this Chapter notwithstanding, in lieu of the appointment of Police and a Chief of Police, the Board of Aldermen may contract with the Sheriff of Gentry County, Missouri, to fulfill the duties and responsibilities of the Chief of Police and Police Officers. Acting under contract, the Sheriff and his deputies shall have the same authority as a City Police Officer and shall enforce the ordinances of the City and enjoy all of the powers and duties of appointed Police. During the time such a contract is in effect, the appointive office of Chief of Police will be vacant. In the event any such contract is terminated, the Mayor will appoint a Chief of Police pursuant to Section 200.050, to resume the duties and responsibilities required by ordinance at the time of termination of any such contract.
The City Administrator, with the consent and approval of the Mayor and Board of Aldermen, shall appoint the Police of the City of Albany.

The Police Officers so appointed shall have power to serve and execute all warrants, subpoenas, writs or other process, and to make arrests in the same manner as a Chief of Police. They shall be conservators of the peace and shall be active and vigilant in the preservation of good order within the City.

Except for those duties prescribed by the laws of the State of Missouri to be performed by the Chief of Police alone, the Police Officers of the City of Albany shall have all of the powers and duties of the Chief of Police and shall execute such orders as the Mayor or Board of Aldermen may require.

There is hereby created and established the position of Police Chief for the City of Albany, Missouri.

A qualified person shall be appointed Police Chief for the City of Albany by the Mayor; such appointment shall be approved by a majority of the Board of Aldermen.

The person appointed to the position of Police Chief shall be at least twenty-eight (28) years of age and shall be a resident of the City of Albany at the effective date of such appointment.

The Police Chief shall receive such compensation as may be determined from time to time by the Board of Aldermen and such compensation shall be payable semi-monthly.

The Police Chief shall serve at the pleasure of the appointing authority. The Mayor, with the consent of a majority of the Board of Aldermen, may remove the Police Chief from office at will, and such Police Chief may also be removed by a vote of the Board independently of the Mayor's approval or disapproval. If requested, the Mayor and Board shall grant the Police Chief a public hearing within thirty (30) days following notice of such removal. During the interim, the Mayor, with the approval of a majority of the Board, may suspend the Police Chief from duty, but shall continue his salary for two (2) calendar months following the final removal date, provided however, that if the Police Chief shall be removed for acts of dishonesty or acts of moral turpitude, such salary shall not be continued.

A. 
General Supervision and Control. The Police Chief shall have direct control and supervision of the Albany Police Department. He shall be responsible to the Mayor and the Board of Aldermen for the efficient operation of the Police Department.
B. 
Purchasing. The Police Chief shall be the purchasing agent for the City of Albany Police Department and all purchases amounting to less than one hundred dollars ($100.00) shall be made under his direction and supervision.
C. 
Budget. The Police Chief shall prepare a budget for the efficient operation of the Police Department. The budget shall be submitted to the City Administrator for submittal to the Mayor and Board of Aldermen.
D. 
Monthly Reports. The Police Chief shall prepare and present to the Mayor and Board of Aldermen for adoption such measures as he may deem necessary or expedient for the health, safety and welfare of the residents of the City of Albany.
E. 
Ordinance Formulation. The Police Chief shall recommend to the Mayor and Board of Aldermen adoption of such measures as he may deem necessary or expedient for the health, safety and welfare of the residents of the City of Albany.
F. 
Record Keeping. The Police Chief shall keep full and accurate records of all actions taken by him and the Police Department.
G. 
Law Enforcement Duties. The primary mission of the Police Chief and the Police Department shall be:
1. 
To present programs of public awareness and crime prevention to the residents of Albany.
2. 
To suppress crime.
3. 
The preservation of law and order.
4. 
The enforcement of the criminal and traffic laws of the State of Missouri and the criminal and traffic ordinances of the City of Albany, Missouri.
5. 
The detection and apprehension of criminal and traffic offenders.
6. 
The recovery of stolen property.
7. 
Such other duties and responsibilities as may be imposed by law.

No member of the Board of Aldermen shall directly interfere with the conduct of the Police Department or duties of employees subordinate to the Police Chief except at the express direction of the Board or with the approval of the Police Chief.
