There is hereby established an Emergency Management Council. This Emergency Management Council shall be composed of not more than 15 members who shall be appointed by the Mayor of the municipality and shall hold office at the will and pleasure of the Mayor.
The Mayor shall appoint a resident of the Township to be the Emergency Management Coordinator (EMC) and the EMC shall be Chairperson of the Emergency Management Council. The EMC shall serve for a term of three years, the first three-year term ending January 1, 1991.
A. 
It shall be the duty of the Emergency Management Council to assist the municipality in establishing the local volunteer agencies needed to meet the requirements of all local civilian defense and disaster control activities in accordance with the rules and regulations established by the Governor of the State of New Jersey pursuant to the provisions of N.J.S.A. App. A:9-30 et seq.
B. 
The Emergency Management Council is authorized, to the extent said money is appropriated, to establish an adequate organization to assist in supervising and coordinating the civilian defense and disaster control activities within the Township.
Membership on the Emergency Management Council shall not bar said person from serving on other agencies created as a result of any other emergency or in preparation for any potential emergency which may occur in the future.
A. 
Said appointment and the EMC's right to continue for the full term of his/her appointment shall be conditioned upon the successful completion, at the time of the appointment or within one year immediately thereafter, of the current approved home study course and the basic emergency management course. The failure of any EMC to fulfill the above-stated requirement within the period prescribed shall disqualify the Director from continuing in the office of EMC, and thereupon a vacancy in said office shall be deemed to have been created.
B. 
The Governor of the State of New Jersey may remove the EMC at any time for cause. In such event, the Mayor of the municipality shall appoint a new EMC with the approval of the Governor of the State of New Jersey. If the Mayor shall not appoint an EMC within 10 days after such office shall become vacant, the Governor of the State of New Jersey may appoint a temporary EMC, who shall serve and perform all the duties of that office until such time as a new EMC shall be appointed by the Mayor with the approval of the Governor of the State of New Jersey.
The EMC shall appoint a Deputy Emergency Management Control Coordinator (Deputy EMC) whose appointment shall be subject to the approval of the Mayor of the Township. The Deputy EMC shall have a three-year term running simultaneously with that of the EMC and shall be chosen from among the salaried officers or employees of the Township.
Whenever in his/her opinion a disaster has occurred or is imminent in the Township, the EMC shall proclaim a state of local disaster emergency within the Township. The EMC, in accordance with regulations promulgated by the state's Civilian Defense Director, shall be empowered to issue and enforce such orders as may be necessary to implement and carry out disaster control operations and to protect the health, safety and resources of the residents of the municipality.
A. 
The EMC shall prepare a written emergency operations plan (EOP), with appropriate annexes necessary to implement the plan, no later than one year after the State Emergency Planning Guidelines have been adopted by the State Office of Emergency Management. The EOP shall conform to all relevant federal statutes, rules or regulations and shall identify significant hazards affecting the Township. The EOP shall be based upon criteria, objectives, requirements, responsibilities and concepts of operation to implement all appropriate protective remedial measures to be taken in response to a potential or actual emergency as determined by the State Director of Emergency Management. The EOP shall be reviewed and updated at least every two years.
B. 
The EOP shall be submitted to the State Office of Emergency Management, and the EOP of the Township shall not take effect until the State Office of Emergency Management has approved the same.
C. 
The EMC is authorized to apply for grants from the State Office of Emergency Management to assist in the development of the EOP and to accept technical assistance from the state or county on the formulation of an EOP on behalf of the Township.
