As used in this chapter, the following terms shall have the meanings indicated:
LAWN CARE
The commercial practice of the care and maintenance of lawns.
LAWN-CARE COMPANY
A company which engages, in whole or in part, in lawn care.
TREE SPRAYING
The commercial practice of spraying trees for the purpose of tree maintenance.
TREE-SPRAYING COMPANY
A company which engages, in whole or in part, in tree spraying.
A. 
Any lawn-care company or tree-spraying company which conducts business in the Township of Mount Olive is required to submit to the Health Officer a registration form prior to conducting such business. A lawn-care or tree-spraying company which performs lawn care or maintenance on a lawn located in the Township of Mount Olive or sprays trees located in the Township of Mount Olive shall be deemed to be conducting business in the Township of Mount Olive.
B. 
The Health Officer shall make available registration forms. All registration forms shall be deemed confidential records not available for public inspection.
C. 
Registration forms shall be drafted by the Health Department and shall require the registrant to disclose basic data concerning the company's place of business, emergency contact information and similar data. The registrant shall also disclose which chemicals, substances or other agents are used by its personnel in lawn care or tree spraying in the Township of Mount Olive.
D. 
The Health Officer shall maintain a file of all completed registration forms. Registration forms may be released by the Health Officer only to other Township officials or to medical or emergency personnel and only upon the Health Officer's determining that exigent or emergency circumstances warrant disclosure. Exigent or emergency circumstances shall be those conditions which pose a present threat to life or property, such as poisoning, fire, explosion or similar circumstances.
Any company which is required by law to submit to the New Jersey Department of Environmental Protection a list of any and all hazardous substances on its premises or in its possession may submit to the Township Health Officer a copy of the form or list of hazardous substances which it has submitted to the New Jersey Department of Environmental Protection, and such submission may be in lieu of submitting a registration form and shall comply with the registration provision of this chapter. Such a document shall be treated as confidential, in the same manner as set forth herein for registration forms.
This chapter shall not apply to any company which does not spray or treat lawns with any substances and whose lawn-care practice is limited to trimming, cutting, pruning and similar activities.

Violations of this chapter shall be punished by a fine of not less than $5 nor more than $500. Every separate day of violation shall be considered a separate and distinct offense.
