[Adopted 3-19-1975 as Ch. 37, Art. I, of the 1975 Code]
Pursuant to the authorization granted by Section 1502, Subsection XXVI, of the First Class Township Code,[1] the owner, tenant or occupier of any lands in the Township of Ridley are jointly and severally required to remove all grass in excess of six inches, together with all weeds and brush growing on any lands owned or occupied by them.

The Health Officer or other designated official is hereby authorized and directed to serve a notice on any such owner, tenant or occupier of lands, notifying such persons that such grass, weeds or brush shall be removed within a period of 10 days from the receipt of such notice, and that such notice is a constructive notice as to all future violations for the period of one year from the date of issue. Said notice shall also state that if at any time within one year after notice is issued the occupier fails to comply with § 88-1 of this chapter, the Township will cause removal pursuant to § 88-3 of this chapter. Service of such notice may be effected by personal service, by certified mail or, in any case that such notice cannot be served in either of said manners, by posting the same at a conspicuous place on the premises.
A. 
In default of the removal of such grass, weeds and brush within the time set forth in said notice, the Township may cause the same to be done and collect the cost thereof, together with a penalty of 10% of such cost, in the manner provided by law for the collection of municipal claims, or by action of assumpsit without the filing of a municipal claim.
B. 
In addition to the above, whenever a code officer makes any inspections of the property after the initial site visit, the Township shall charge such person an administrative/inspection fee of $50 per inspection.

The Superintendent of Highways is hereby directed to keep accurate records of all removals of such grass, weeds and brush, and to certify the cost of such removals to the Township Secretary and report the same to the Board of Township Commissioners for appropriate action.

The maintenance of any such grass, weeds or brush after the period of time set forth in said notice is hereby declared to be a nuisance, prejudicial to the public health or safety, and any owner, tenant or occupier of lands having received such notice as provided in § 88-2 hereof, who fails, refuses or neglects to comply with such notice shall, upon conviction before a District Justice, be sentenced to pay a fine not exceeding $1,000, plus costs of prosecution, and in default of payment of such fine and costs shall be imprisoned for a period not to exceed 30 days. Each day such a violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
