The purpose of this chapter is to regulate the standards and
manner in which secondhand metals are sold and purchased and the manner
in which secondhand metal businesses are operated and maintained within
the Township of Haddon in order to ensure the protection of the public
health, safety and welfare of the residents of the Township and to
assist federal, state and local law enforcement agencies in their
efforts to eliminate the sale and purchase of stolen secondhand metals.
For the purpose of this chapter, the following terms shall have
the following meanings:
ALUMINUM MATERIALS
Any aluminum cable, bar, rod, pipe or tubing of the type
used to construct utility, communication or broadcasting towers, aluminum
utility wire, aluminum radiators not attached to a motor vehicle,
aluminum irrigation pipe or tubing, or any aluminum artwork, ornament,
roofing or railing, whether composed of aluminum or alloys thereof,
or any combination of the above. "Aluminum materials" does not include
aluminum cans that have served their original economic purpose.
CHIEF OF POLICE
The Chief of the Haddon Township Police Department, or his
or her designee.
COPPER MATERIALS
Any copper wire, bar, rod, pipe or tubing, including copper
wire or cable or coaxial cable of the type used by public utilities,
common carriers or communication services providers, whether wireless
or wire line, copper air-conditioner evaporator coil or condenser,
copper or aluminum-copper radiator not attached to a motor vehicle,
or any copper artwork, ornament, roofing or railing, whether composed
of copper or alloys thereof, or any combination of the above.
DEALER IN SECONDHAND METALS or SECONDHAND METAL BUSINESS
A person who buys, sells and/or stores, or is in the business
of buying, selling and/or storing, secondhand metals. As used in this
chapter, "dealer in secondhand goods" or "secondhand metal business"
shall also mean and include the property, lot, parcel, location, yard,
place or space at or from which the business of a dealer in secondhand
metals or secondhand metal business is conducted.
METAL ELECTRICAL WIRE
Any household or industrial metal electrical wiring, other
than that used to transmit data or voice by telephone, computer or
similar device.
METAL GAS PIPE
Any segment of piping of the type commonly used for natural
gas, whether made of copper, iron or any other metal.
METAL PLUMBING PIPE
Any segment of piping of the type commonly used for water
supply, sewage or drainage, whether made of copper, iron or any other
metal. Metal plumbing pipe shall not be deemed to include pipes or
ducts of the type commonly used in heating, ventilation and air conditioning
("HVAC").
PERSON
An individual, firm, corporation, limited liability company,
partnership and/or any other type of organization or business entity
of any kind.
RAILROAD TRACK MATERIALS
Any rail, switch component, spike, angle bar, tie plate or
bolt of the type used in constructing railroads.
SECONDHAND METALS
Any aluminum materials, copper materials, metal electrical
wire, metal gas pipe, metal plumbing pipe and/or railroad track materials,
as such materials are defined in this chapter. "Secondhand metals"
also include electrical, communications or utility brass, stainless
steel sinks, catalytic converters not attached to a motor vehicle,
metal beer kegs and such other objects composed of a metal material
that is commonly sold and bought by secondhand metal dealers. "Secondhand
metals" does not include ferrous metals not listed in this section
or first-generation metals, meaning any metal, metal object or product
containing any of the metals defined herein, which metal, metal object
or product is being used in the form and/or by the user for which
it was originally produced or intended.
