A. 
No person shall establish, operate, maintain or expand the business or trade of a dealer in secondhand metals without first obtaining a license pursuant to the requirements of this chapter. The licensee, by accepting a license hereunder, agrees to comply with all of the terms and conditions set forth in this chapter.
B. 
The license required by this chapter shall be issued by the Township Clerk in accordance with the requirements of this chapter.
C. 
A license issued pursuant to this chapter shall authorize the licensee to conduct the business regulated by this chapter only at, on and/or upon the premises specified in the license. It shall be unlawful for any person to post a license on a premises other than the premises for which the license was issued.
D. 
A license issued pursuant to this chapter shall be prominently displayed in a conspicuous place on the licensed premises at all times. It shall be unlawful for any person to knowingly deface or destroy a license issued and posted in accordance with this chapter.
E. 
No license issued pursuant to this chapter may be assigned or transferred in any manner for any reason. Any licensee who wishes to change the location of the premises where the licensed business operates shall be required to apply for a new license and shall follow all requirements of this chapter regarding such application.
A. 
Notwithstanding anything in Chapter 154 to the contrary, any person applying for a license pursuant to this chapter shall provide the following information:
(1) 
The name, address, telephone number, cellular telephone number and current e-mail address and website of the applicant.
(2) 
The name and address of all shareholders, members, partners, directors, officers and registered agent(s) of the applicant. If any such shareholder, member or partner is itself a business entity of any kind, the applicant also shall provide the name and address of all shareholders, members, partners, directors and registered agents of same.
(3) 
All details pertaining to the business proposed to be conducted, including but not limited to identification by block and lot of the specific property upon which the business is proposed to be conducted.
(4) 
Whether the applicant or any of the applicant's shareholders, members, partners, directors, officers or owners have been convicted of any criminal offense or ordinance violation (other than traffic or parking offenses) in any jurisdiction and, if so, a list of such convictions, with date and prosecuting jurisdiction.
(5) 
Whether the applicant or any of the applicant's shareholders, members, partners, directors, officers or owners have held a license or had an interest in a license issued by this or any other jurisdiction regulating the purchase and sale of secondhand metals which license was revoked and, if so, list the date of revocation and the jurisdiction.
(6) 
A copy of the zoning permit and resolution of approval from the Planning Board or Zoning Board as required by § 156-5A(2) and (3).
(7) 
The application fee required by § 111-21 of the Code of the Township of Haddon.
B. 
In the event any employee or personnel of the Township of Haddon who is charged with reviewing an application for a license pursuant to this chapter determines that the application is incomplete or fails to provide sufficient information to enable such person to perform his or her duties with respect to reviewing same, the applicant shall be required to provide such additional information as such person reasonably may require to enable him or her to fulfill his or her duties hereunder.
A. 
No license shall be issued unless the following requirements are met:
(1) 
The applicant has submitted all information required by this chapter and such additional information as the processing personnel within the Township may reasonably require.
(2) 
The applicant has obtained site plan approval from the Planning Board or Zoning Board, as applicable.
(3) 
The applicant has obtained a zoning permit from the Zoning Officer.
(4) 
The report of the Police Department required in Subsection B below has been provided to the Township Clerk for consideration by the governing body as provided in § 156-6 below.

(5) 
The applicant has paid the fee required by § 111-21 of the Code of the Township of Haddon.
B. 
Investigation of application by Police Department. Upon receipt of an application for a license in accordance with this article, the Township Clerk shall cause a copy thereof to be sent to the Police Department, which shall provide a report and recommendation to the Township Clerk within 21 days. The report required by this section shall indicate whether any of the applicant's shareholders, members, partners, directors, officers or owners have a criminal history and shall include a statement of whether any such criminal history would lead the Chief of Police to recommend that the application for a license hereunder be denied. Notwithstanding the foregoing, nothing herein shall be construed to require the Police Department to disseminate to any person a copy of any criminal history report obtained pursuant to this section, nor shall such report be disseminated to the Township Clerk with a copy of the report and recommendation required by this section.

A. 
All applications for a license hereunder shall be submitted for review and consideration by the governing body pursuant to the requirements of this section. The governing body shall consider the reports filed pursuant to § 156-5 and shall vote to approve or deny each license application after:
(1) 
Considering whether the public safety will be jeopardized by issuance of the business license; and
(2) 
Examining the qualifications of the applicant to determine whether said applicant is of good moral character and otherwise is not in violation of any laws of the State of New Jersey or any provision of the Code of the Township of Haddon.
B. 
The governing body shall approve or deny an application for a license within 30 days of receipt of same by the Township Clerk. In the event the governing body fails to take action within said period of time, the business license application shall be deemed denied unless the governing body takes action to extend the thirty-day period for a reasonable period of time for any reason which the governing body may reasonably determine. In no event, however, shall the time be extended beyond 60 days such that any application not acted upon within 60 days shall be deemed approved nunc pro tunc to the date same was first filed with the Township Clerk.
C. 
Any applicant aggrieved by the action of the governing body hereunder may, within 10 days of the date of the action complained of, request a reconsideration hearing before the governing body. Such hearings shall be conducted in the same manner as a revocation hearing pursuant to Article IV of this chapter, including without limitation the notice provisions thereof.
All licenses issued by the Township Clerk in accordance with this article shall include, without limitation, the following information:
A. 
The license number assigned to the license by the Township Clerk, which shall be assigned or numbered sequentially by year and then numerically in the order of the number of licenses issued;
B. 
The name of the person or business entity to whom the license was issued;
C. 
The location where the person or business entity is licensed to conduct business as a dealer in secondhand metals, including the street name, street number, block and lot thereof; and
D. 
The expiration date of the license.

Every license issued in accordance with this article shall be valid from January 1 to December 31 of the following year. Any license issued after January 1 shall expire on December 31 of the following year after which it was issued. The fee for each two-year license shall be as provided in § 111-21 of the Code of the Township of Haddon.
A. 
Prior to delivering any approved license to the person or business entity identified in such license, the Township Clerk shall assign a number to the license and shall record in a book kept solely for the purpose stated herein the following information for each license:
(1) 
The license number, which shall be assigned in the manner required in § 156-7B(1) above;
(2) 
The name of the person to whom the license was issued; and
(3) 
The location for which the license was issued and the date the license was issued.
B. 
In the event a license issued pursuant to this chapter is revoked as provided for in this chapter, the Township Clerk shall record in the same book the date the license was revoked.
C. 
The book maintained by the Township Clerk as required in this section shall be labeled "Licenses - Dealers in Secondhand Metals" and shall be made available during normal business hours for inspection by the Police Department of the Township of Haddon, the Camden County Prosecutor and any other federal, state or local governmental agency with jurisdiction, and/or the appointed or designated representative or representatives of each.
