A. 
Every person convicted of a traffic infraction for a violation of any provision of Part 2 which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than $100; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $150; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $300.
B. 
Notwithstanding the provisions set forth hereinabove, the penalties for a violation of § 295-27, All-night parking and § 295-55, Limited Time Parking shall be as follows:
(1) 
Fine paid within 10 days of violation: $35.
(2) 
Fine paid within 11 to 30 days of violation: $70.
(3) 
Fine paid within 31 days or more after violation: $140.
A. 
Except those parts, if any, which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York and § 46 of the Highway Law of the State of New York, Part 2 and any regulations adopted hereunder shall take effect as provided by law.
B. 
Any part or parts of Part 2 and any regulations adopted hereunder which are subject to approval under § 1684 of the Vehicle and Traffic Law and § 46 of the Highway Law of the State of New York shall take effect from and after the day on which approval in writing is received from both the New York State Department of Transportation and the New York State Department of Public Works.[1]

All prior ordinances, regulations and rules or parts of such of this Town regulating traffic and parking are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person, for any act done or committed in violation of any ordinance, regulation or rule hereby repealed prior to the taking effect of Part 2.
