A. 
Whenever according to the Code of Ordinances or according to any ordinance of the City an act is prohibited or required or the doing of an act or the failure to do an act is made or declared to be unlawful, for which there is no specific penalty provided in the Code of Ordinances or ordinances for such act or failure to act, the violation of such provision shall be punished by a fine not to exceed five hundred dollars ($500.00) or by imprisonment not to exceed six (6) months, or by both such fine and imprisonment.
B. 
Each day any violation of any provision of the Code of Ordinances or an ordinance of the City continues shall be a separate violation.
C. 
In addition to the penalty hereinabove provided, any condition caused or permitted to exist in violation of any of the provisions of the Code of Ordinances or an ordinance of the City shall be deemed a public nuisance and may be, by the City, abated as provided by law and each day that such nuisance continues shall be regarded as a new and separate offense.
D. 
Minor Traffic Violations. The punishment of a "minor traffic violation," as defined by Section 300.010 of the Chillicothe City Code, shall be subject to the following:

1. 
The maximum fine and court costs that can be imposed for the violation of any minor traffic violation shall be three hundred dollars ($300.00).
2. 
Minor traffic violations shall not be punishable by imprisonment, unless the violation:
a. 
Involved alcohol or controlled substances,
b. 
Endangered the health or welfare of others, or
c. 
Involved eluding or giving false information to a Law Enforcement Officer.
3. 
A person convicted of a minor traffic violation shall not be placed in confinement for failure to pay a fine unless such non-payment violates the terms of the person's probation.
4. 
Court costs shall be assessed against such person unless the court finds that the defendant is indigent.
5. 
No court costs shall be assessed if the case is dismissed.

All fines and costs collected for the violation of any provision of this Code shall be turned into the City Treasury to the credit of the General Fund.
