Without special permission of the Borough Council, no person, partnership, firm or corporation shall keep or store within the limits of the Borough of Vandergrift any fertilizer, phosphate, bone dust or other odorous substance, if the odor of such substance is noticeable by any person residing on or occupying premises nearby or using any of the public thoroughfares in the vicinity. Such permission may be granted, at the discretion of the Council, where such substance or substances are to be kept or stored temporarily, pending removal to another place or use about the premises. Such permission may be conditional, with such conditions stipulating the substances and the maximum quantity thereof that may be kept or stored, the maximum length of time for keeping the same upon the premises, and the place and manner of storage or keeping of the same upon the premises.
The Borough Council may order the owner or occupant of any premises to remove or cause to be removed therefrom any substance or substances kept or stored thereon in violation of any of the provisions of this chapter or of the conditions of any permission granted hereunder. If any such substance or substances shall not be removed therefrom within 24 hours after receipt of notice of such order, the Council may cause the same to be removed and may cause the cost of such removal, together with a penalty of 10% thereof, to be collected from such defaulting owner or occupant, provided that such cost and additional charge shall be in addition to any penalty imposed under § 219-3.

Any person, partnership, firm or corporation who or which violates any provision of this chapter shall, upon conviction, be sentenced to pay a fine of not less than $200 or more than $1,000 and costs of prosecution and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days.
