GENERAL REFERENCES
Peace and good order — See Ch. 337.
As used in this chapter, the following terms shall have the
meanings indicated:
The Borough of Vandergrift, County of Westmoreland and Commonwealth
of Pennsylvania.
The entire width between the boundary line of every maintained
area when any portion thereof is opened to the use of the public for
vehicular traffic, including, but not limited to, streets, alleys,
roads, boulevards, etc.
A device having either a single set of in-line wheels or
multiple sets of wheels or shoes with a single set of in-line wheels
or with multiple sets of wheels which can either be attached to the
feet in the form of a shoe or roller skate or an in-line skate or,
in the alternative, can be a device upon which the feet are placed
and which may be used as a scooter-type device containing either two
wheels or multiple sets of wheels and which may or may not have a
handle-bar-type device, all of which would be utilized to glide over
hard surfaces by an individual or individuals.
A device consisting of a flat surface constructed of a variety
of products, including, but not limited to, plastic, fiberglass, wood
or similar material with two or more wheels affixed to the underside
and which is used by a person for coasting and guided by the user.
It shall be unlawful for any person to use a skateboard, roller
skates or street skates on any public street within the Borough and
in or on the following public areas:
A.
The basketball courts located between Jackson Avenue and Linden Street;
B.
The tennis courts located between Jackson Avenue and Linden Street;
C.
The parking lot of the Borough of Vandergrift located on Longfellow
Street, Columbia Avenue, in the area between Washington Avenue and
Custer Avenue in the Borough of Vandergrift;
D.
The area on or around (excluding the sidewalk) of the Casino Theatre
and the Vandergrift Borough Municipal Building located at 109 Grant
Avenue, including the parking lot area; and
E.
The gazebo located in Kennedy Park.
Roller skates, skateboards and street skates may be operated
on sidewalks within the Borough of Vandergrift between 8:00 a.m. and
sunset, provided that the operator of the skateboard, roller skates
or street skates shall display responsible conduct when operating
the skateboard, roller skates or street skates and shall do so in
a responsible manner and shall always yield the right-of-way to pedestrians,
and it shall be unlawful for any person to use any skateboard, roller
skates or street skates on any sidewalk in a careless manner.
Any person who shall violate any provision of this chapter shall
be subject to the following penalties:
A.
First offense. The skateboard, roller skates or street skates shall
be impounded by the Police Department of the Borough for a period
not to exceed 15 days.
B.
Second or subsequent offense. The skateboard, roller skates or street
skates shall be impounded by the Police Department of the Borough for
a period not to exceed 30 days and/or the user shall be sentenced
upon conviction to pay a fine of not more than $25 plus all court
costs; provided, however, that should said person be a minor, the
skateboard, roller skates or street skates shall be impounded by the
Police Department of the Borough for a period not exceeding 30 days
and the parent, guardian or other person having legal custody of said
minor shall be, upon conviction, sentenced to pay the fine of $25,
plus all court costs.
