The Chief of Police of the Village of South Nyack-Grand View Police Department, whenever he deems the public interest requires it, may request the chief executive officer of any other local government to detail, assign, make available for duty and use in the Village of South Nyack any part of the forces, equipment and supplies of the police department, police force or parkway police force of the local government of which the request is made.
The Chief of Police of the Village of South Nyack-Grand View Police Department is hereby authorized to provide the assistance of the regularly employed law enforcement officers, equipment and/or supplies of the Village of South Nyack to any municipality within Rockland County and the Town of Tuxedo and Village of Tuxedo Park requesting such assistance to aid in coping with situations where there exists in such other municipality a need for the services of additional law enforcement officers, their equipment and/or supplies to protect the health, life and property of such other municipality, its inhabitants and the visitors thereto. The assistance offered shall be in accordance with the provisions of § 209-m of the General Municipal Law of the State of New York.

A. 
On account of the pending dissolution of the Village of South Nyack, it has become necessary to prepare for the disbanding of Village departments; and
B. 
Among the departments that must be disbanded is the South Nyack Police Department;
C. 
Following the disbanding of the South Nyack Police Department, the Village shall be served by the Orangetown Police Department, with no interruption in service to residents.
A. 
In accordance with the provisions of former § 47-12 of the Code of the Village of South Nyack, adopted via Local Law No. 5 of 1982, the joint Police Department known as the "South Nyack – Grand View Police Department" is hereby dissolved effective May 31, 2021.
B. 
The South Nyack Police Department shall be disbanded as of 12: 00 a.m. on January 1, 2022.
C. 
The South Nyack Police Department shall be disbanded as of 12:00 midnight on January 1, 2022.

As set forth in Section IX of such local law, effective May 31, 2021, all members of the South Nyack — Grand View Police Department shall become employees of the Village of South Nyack.
A. 
There is hereby established a South Nyack Police Department to serve the geographic area of the Incorporated Village of South Nyack in accordance with Village Law § 8-800.
B. 
This Police Department shall be known as the "South Nyack Police Department."
C. 
The Police Department established by this article shall enforce all the laws of the State of New York and all local laws and ordinances of the Village of South Nyack in the geographic area served by the Department.
The Police Department shall be administered by the Board of Trustees of the Village of South Nyack, which shall have general administrative authority. The Mayor or Acting Mayor of the Village of South Nyack shall be the presiding administrative officer. Meetings of the Board of Trustees of the Village of South Nyack involving Police Department business shall be held at the discretion of the Board of Trustees.
A. 
The Board of Trustees of the Village of South Nyack shall be the appointing authority for the South Nyack Police Department and shall appoint all patrolmen of the police force. The Chief of Police of the force shall be appointed by the Board of Trustees. The Chief of Police of the joint South Nyack – Grandview Police Department shall serve as the initial Chief of Police of the South Nyack Police Department. All present full-time and part-time police officers of the joint South Nyack – Grand View Police Department shall constitute and be members of the South Nyack Police Department. They shall have all the seniority rights that they have in the joint South Nyack – Grand View Police Department at the time that this article shall become effective. Any labor agreements currently in force in the joint South Nyack – Grand View Police Department shall apply to the South Nyack Police Department.
B. 
All appointments shall be in accordance with the Civil Service Law of the State of New York, the rules and regulations of the Rockland County Personnel Office, and the Public Officers Law of the State of New York and the Rockland County Police Act. Any individual appointed as a police officer, Sergeant or Chief of Police prior to the enactment of South Nyack Local Law No. 2-2018 shall be exempted from the former requirement that they be a resident of the County of Rockland.
C. 
On or before February 1 of each year, the Chief of Police shall present a tentative budget for the ensuing fiscal year to the Board of Trustees of the Village of South Nyack. The Board of Trustees shall make such changes in the Police Department's tentative budget as it deems necessary and shall forward the Police Department's tentative budget, as amended, to the Village Clerk of the Village of South Nyack on or before March 15 of each year for inclusion in the tentative budget of the Village of South Nyack. Whereas prior to the enactment of this article, a separate public hearing was held by the Village for the Police Department's budget, the Police Department's budget shall now be included as part of the public hearing to be held on the Village's budget generally.
D. 
The Board of Trustees of the Village of South Nyack shall have the authority to adopt, amend and nullify rules and regulations relating to the operations of the South Nyack Police Department. The Board of Trustees shall also have the authority to enter into contracts with the members of the Police Department.
A. 
Fiscal Affairs for the South Nyack Police Department, including matters relating to payments and disbursements of funds budgeted for the Police Department, shall be handled in the same manner as payments and disbursements of funds are handled by the Board of Trustees of the Village of South Nyack for other departments of the Village of South Nyack.
A. 
Except insofar as modified or changed by this article, all provisions of the Village Law, Town Law, General Municipal Law, Civil Service Law and all other laws of the State of New York shall continue to apply to the South Nyack Police Department.
B. 
The Justice Court of the Village of South Nyack shall continue to have jurisdiction over matters to be handled by the South Nyack Police Department.
All insurance policies of the Village now in effect shall be endorsed to include the Village of South Nyack, the Board of Trustees of the Village of South Nyack, and the South Nyack Police Department.
Discipline and charges shall be as provided in § 8-804 of the Village Law and the Rockland County Police Act. Review shall be as provided in § 8-806 of the Village Law.
The Village Board of Trustees shall have the absolute right to dissolve the South Nyack Police Department via local law.
This article shall take effect on May 31, 2021.
