From and after the passage of this article, it shall be the
duty of occupants of property abutting on any sidewalk in the Borough
and, if there are no occupants, then the owners of said property,
to keep their sidewalk in a safe and usable condition and to keep
the same at all times free and clear from weeds, leaves, dirt, rubbish,
wastepaper, refuse of any kind and snow and ice.
From and after the passage of this article, it is prohibited
for any owner or occupant of any property within the Borough to plant
trees, shrubbery or plants of any kind, excepting grass, in the space
between their sidewalk and the paved vehicular driveway.

As used in this article, the following terms shall have the
meanings indicated:
SIDEWALK
Includes the paved footway in the portion of any street located outside the paved vehicular driveway, as established by Article
I, Sidewalk Construction and Maintenance, of this chapter.

Upon failure or neglect of any occupant or property owner to comply with the provisions of this article, the Borough shall give written notice to comply within 48 hours with the requirements of §
115-16 hereof, and written notice to within 10 days remove the violations prohibited in §
115-17. Upon failure by the occupant or property owner to comply within the period specified after delivery of said notice, the Borough may remove the impediments from the sidewalks or the grassy plots between the sidewalk and the paved vehicular driveway and may file a lien therefor against said property for the costs and expenses thereof, together with all additional charges, expenses and penalties as authorized by law, or take such other steps permitted by law to collect said costs and charges.

Failure to comply with the foregoing sections of this article
will make the occupant or owner liable to a fine of not more than
$600, to be recovered for the use of the Borough before the Magistrate
as fines of like amount are by law recoverable, the same to be paid
into the Borough Treasury.
