The Karn property located across from Ninth Avenue to the Borough
line with Perkiomen Township, between Route 29 and the Perkiomen Creek,
and the Mill property located on the east side of Route 29, including
the 1,740 feet by irregular on the Lower Providence side of the creek,
have been designated as passive recreation and open space for use
by the citizens of Collegeville.

The ballpark and playground, located on Park Avenue between
Third and Fourth Avenues, the Scout Cabin, located on Clamer Avenue,
and Hunsberger Woods have been designated as active recreation areas.

A. Passive recreation. The passive recreation areas designated in §
449-1 are open throughout the year to all Borough residents and their guests, when accompanied by Borough residents. They are open between 7:00 a.m. and darkness.
B. Active recreation. The active recreation area is open throughout
the year to all Borough residents and their guests when accompanied
by Borough residents. The ballpark and playground are open between
7:00 a.m. and 9:30 p.m. Areas within the ballpark and playground which
receive lighting from within the park will be considered to be open
while the lights are on.
C. No person shall be within the passive recreation and open spaces or active recreation areas between the time of darkness or the time when the lights are extinguished at 9:30 p.m. and until 7:00 a.m. except during fishing season, when licensed individuals for that purpose will be permitted in passive recreation areas. Parking along the park property on Fourth Avenue after 9:30 p.m. is prohibited, and persons so illegally parked shall be subject to the penalty prescribed in §
640-26.

D. Darkness shall be specifically defined to mean 1/2 hour after sunset
and 1/2 hour before sun-up during the prevailing time legally established
and in effect under the laws of the Commonwealth of Pennsylvania.
No person shall damage, injure, deface, remove, cut or change
any of the trees, plants, shrubs, turf, building structures or fixtures
therein, or any property of the Borough located within the park areas.
No person shall remove any Borough property from the Borough
parks.
No conduct shall be permitted within any park which causes annoyance
to any other person, nor shall obscene language be used, nor shall
conduct of any immoral or indecent nature be permitted.
No person shall sell, or set up any booth, table or stand for
the sale of any article within the limits of any of the park areas
without the consent of the Borough Park and Recreation Committee,
which shall have authority to refuse such consent in any instance.
No person shall dispose of any waste or garbage in the park
lands, except in a receptacle designated for the respective purposes;
and, all persons using any of the park areas shall dispose of all
waste and garbage left in proper receptacles.
No person shall injure, deface or destroy any notice, rule or
regulation, posted any place within the park area, nor shall any person
post any place within such park lands any notice or placard other
than official signs and notices posted by and under the authority
of the Park and Recreation Committee or Borough Council.

A. Definitions. As used in this section, the following terms shall have
the meanings indicated:
ON OR ABOUT THE PERSON
The location of any container, bottle, or can containing
any alcoholic beverage which is nearby, close at hand, convenient
of access, and within reach of the party.
OPENED
The condition of a container whose cap, cork, top, or other
closing device has been removed, or the condition of a can which is
punctured or pulled open so as to break its seal.
POSSESSION
The exercising of the conscious dominion or control over
any container, bottle, or can containing an alcoholic beverage.
PUBLIC PLACE
A public place shall be considered within the street right-of-way
of the Borough of Collegeville, including sidewalk, along with any
public grounds owned by the Borough of Collegeville.
B. Possession or consumption in public prohibited. No person shall have
on or about his or her person, possess, carry, or transport liquor,
wine, beer, or other alcoholic beverages in opened containers in or
about any public sidewalk, street, alley, walkway, public park or
playground, or any other public place in the Borough of Collegeville.
No person shall drink or consume liquor, wine, beer, or any other
alcoholic beverages in or upon any streets, sidewalks, alleys, walkways,
public parks or playgrounds, or any other public place in the Borough
of Collegeville.
C. Applicability. The prohibitions contained in the within section shall
not apply to any person engaged or participating in any event for
which a license has been issued by the Borough of Collegeville or
a state or federal government agency permitting for possession or
consumption of alcoholic beverages on or upon any public place or
places and subject to the conditions within the license.
D. License; fee. A license may be issued by the Mayor or Police Chief
to permit the possession or consumption of alcoholic beverages on
public places at specific times and at specific locations and for
specific locations and for specific purposes for the promotion of
any public parade, celebration, or other similar event. Said license
may only be issued upon payment of a fee, which shall be established
from time to time by resolution of the Borough Council, and the submission
of an application to the Mayor or Police Chief of the Borough of Collegeville.
Said application shall include:
(1) The name, address, and telephone number of the individual, partnership,
corporation, or other entity requesting the license.
(2) The purpose for which the license is requested.
(3) The specific times and places for which the application is made.
(4) Any such further information as may be required by the Secretary
or Manager of the Borough of Collegeville.
(5) In the event that any of the information application is misrepresented
or in the event that any type of disturbance is caused in the public
area at the event for which the license has been issued, the license
may be revoked by the Collegeville Police Department or any office
thereof.
(6) Proof of insurance for the event in an amount as required by the
Secretary or Manager of the Borough of Collegeville, and name the
Borough of Collegeville as an additional insured.
(7) Proof of PLCB license that allows the sale of alcohol off-premises.
(8) Provide a hold harmless/indemnification for the Borough of Collegeville
for any claims that may arise from the sale of alcohol on Borough
property.
(9) Applications must be submitted to the Borough for review more than
30 days prior to the proposed event.

No person shall hunt (or do any form of hunting) with any instrument
used therefor within the boundaries of any Borough park, it being
the intent of the Borough to create in the public parks conditions
favorable to birds, bird life, and animals for the benefit and enjoyment
of the public to whom the parks will be open.
A. With the exception of parking passenger or Borough vehicles in the
parking lot at Hunsberger Woods, no person shall operate any motor-powered
vehicle within any of the park lands except as required by an emergency
or park maintenance. Minibikes, motorbikes, go-carts, snowmobiles,
or any other like vehicle propelled by gasoline internal combustion
engine or propelled by any other kind of fuel are expressly prohibited
in park areas.

B. Motor vehicles will be permitted within the park lands for firefighting
purposes as well as for diving training purposes.
No fires shall be made, tended or maintained within any park
area, except that authorized scouting groups may light fires in park
areas during scout merit badge training programs after having received
a permit from Borough Council.
Gambling of any kind is not permitted within any park area.
No camping shall be permitted in the park area.
Pets must be on a leash which shall measure less than six feet
in length, and such pets must not be permitted to annoy any person
or other animal within a park area.

A. All Collegeville parks and recreational areas are designated tobacco-free,
and the use of any tobacco product or electronic cigarette, in any
form, shall be prohibited hereafter.
B. "Tobacco product" includes:
(1) Any product containing, made, or derived from tobacco or nicotine
that is intended for human consumption, whether smoked, heated, chewed,
absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any
other means, including, but not limited to, cigarettes, cigars, little
cigars, chewing tobacco, pipe tobacco, snuff; and
(2) Any electronic device that delivers nicotine or other substances
to the person inhaling from the device, including, but not limited
to, an electronic cigarette, cigar, pipe, or hookah.
(3) Notwithstanding any provision of Subsection
B(1) and
(2) to the contrary, "tobacco product" includes any component, part, or accessory of a tobacco product, whether or not sold separately. "Tobacco product" does not include any product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product or for other therapeutic purposes where such product is marketed and sold for such an approved purpose.

The parks and recreation areas rules and regulations and related
fee amounts may be amended by resolution as deemed necessary or desirable
by Borough Council.

Any person violating any provision of this chapter (except for the parking prohibitions in §
449-3C) shall, upon conviction by a Magisterial District Judge, within the magisterial district of which the Borough is a part, pay a fine of not more than $600, and upon default in the payment of the fine and costs of prosecution, be imprisoned in the county jail for a period of not more than 10 days.
