In the interest of promoting the public health, safety and general
welfare of the community imposed within the territorial limits of
the Borough of Collegeville, the following regulations are enacted
for the protection of the public health, providing regulations of
retail filling or service stations dispensing gasoline or other flammable
liquids, providing penalties for the violation of the terms of this
chapter for the purpose of enforcing the regulations as follows:
The following regulations for the operation of self-service
gasoline stations, in addition to those regulations of statewide application,
are adopted to protect the health, safety and welfare of the citizens
of this Borough:
A. Dispensing of flammable or combustible liquids into motor vehicles
at self-service gasoline stations with 10 or less positions (places
for vehicles to receive fuel) available for the dispensing of flammable
or combustible liquids into motor vehicles is permitted when the following
conditions are met:
(1) There is at least one attendant on duty while the station is open
to the public. This attendant shall be required to remain within 15
feet of the main power shutoff switch or switches at all time when
flammable or combustible liquid is being dispensed.
(2) Shutoff buttons shall be installed in the place where the cashier
is located controlling any single dispenser or all station dispensers.
(3) Each dispenser island shall be equipped with a fire suppression system
which has been approved by the Borough Fire Marshal.
(4) Food may not be sold at the service station unless it is sold in vending machines except, as provided in Subsection
C of this section.
(5) All dispensers shall be made visible to the attendant on duty at
all times by means of optical or electronic devices, regardless of
the nature of the vehicle parked at the dispenser.
(6) If the attendant on duty is stationed in a control booth or control
room, no gasoline may be dispensed when the attendant is outside of
that booth or room.
(7) The service station shall post signs stating that there is to be
no smoking and that all motors should be shut off.
B. Dispensing of flammable or combustible liquids into motor vehicles at self-service stations with more than 10 positions available for the dispensing of flammable or combustible liquids into motor vehicles is permitted when the conditions set forth in Subsections
A(1) through
(7) of this section are met, and the following additional conditions are met:
(1) In addition to the attendant being required to be on duty at all time pursuant to Subsection
A(1) of this section, there shall be at least one attendant on duty at all times while the station is open to the public for each additional 10 positions available for the dispensing of flammable or combustible liquids.
C. Food may be sold at the self-service station, other than through a vending machine, provided it is prepackaged by the manufacturer or wholesale distributor of the food, at a location away from that of the station, and that an attendant is never more than 15 feet from the main power shutoff switch or switches at the time of the sale; otherwise, the self-service station shall employ an attendant for the dispensing of food only, in addition to the attendant or attendants required to be on duty under Subsection
A(1) of this section.
D. For the purpose of the regulations set forth above, the number of
positions shall be determined by the maximum number of motor vehicles
which can be parked to receive flammable or combustible liquid dispensed
into each vehicle at any one time. The number of positions shall not
be determined by the number of dispensing nozzles.

Any person who violates any provision of this chapter shall
be liable, upon conviction by summary proceedings, to a fine of not
less than $100 and not more than $1,000 and costs of prosecution,
and, in default of fine and costs, to imprisonment for not more than
30 days.
