Smoking is prohibited in all areas of Borough buildings or structures. This includes but is not limited to all work areas, offices, conference rooms, hallways/vestibules, stairwells, rest rooms, elevators, cafeterias, lounges and Borough-operated vans.

Smoking shall be prohibited in all public parks, playgrounds, or other recreational facilities of the Borough of Roselle, as well as being prohibited in all other facilities of the Borough of Roselle where smoking is prohibited in accordance with N.J.S.A. 26:3D-55 et seq., the New Jersey Smoke-Free Air Act.

As used in this chapter, the following terms shall have the meanings indicated:
SMOKING
The burning of any tobacco, cannabis, or cannabis-derived product, whether used in a pipe, cigar, cigarette, or cannabis paraphernalia.
The time away from work for the purposes of smoking outside of Borough buildings and structures shall be limited to the scheduled and/or permitted break periods and meal breaks.
Employees shall make use of outside receptacles for the disposal of cigar or cigarette butts or tobacco by-products and waste.
Department, division heads and supervisors shall be directly responsible for the implementation of the policy and its enforcement within their areas of supervision and control.
Questions of interpretation or application of the policy shall be referred to the Borough Administrator for response.
Violation of this chapter shall result in a fine not to exceed $25 for the first offense nor $100 for subsequent violations.
This chapter shall be enforced by the Roselle Police Department.
