It shall be unlawful for any person to conduct or manage either as owner or lessee any theater or other place wherein motion pictures are displayed or wherein motion-picture machines shall be installed, maintained or operated without having obtained a license for such purpose.
An application for a license to pursue such business shall be filed with the Borough Clerk and shall show the name of the applicant, post office address, the place or premises where such business is to be conducted and such other information as the Council shall deem necessary or proper.
The license required by this chapter shall be signed by the Chief of Police and countersigned by the Borough Clerk. It shall be displayed in a conspicuous place on the premises where the business is conducted, and shall on its face disclose the name and address of the licensee, the address of the licensed premises and the date when the license shall expire.
The license required by this chapter shall be issued to and in the name of the proprietor of the premises where the said business is to be conducted, and shall be issued for one year from the first day of January of the year of such issuance.
The license fee shall be $150, payable with the filing of the application.
No motion-picture machine shall be installed, maintained or operated in any building used for public exhibition that does not abut upon a street. Exits and entrances shall open directly from the exhibition hall onto a street or street and alley. The doors of all exits and entrances shall open outward and all aisles shall lead directly to exits. No aisle or passageway shall be less than three feet in width at its beginning, and such aisle or passageway shall increase in width towards the exits at a ratio of at least 1 1/2 inches to five running feet. The booth enclosing the picture machine shall rest upon a balcony. The motion-picture theater shall be provided with fire escapes placed as and where directed by the Building Inspector; provided, however, that where the entire seating capacity of such theater shall be maintained on the ground floor of any building with no balcony, no fire escape shall be required.
All aisles and passageways in said buildings shall be kept free from obstructions, and no person other than an employee of the licenses premises, a policeman or fireman shall stand in or occupy any of the said aisles or passageways during any performance, exhibition or any public assemblage.

Any person being the owner or lessee who shall conduct or cause to be conducted any motion-picture theater required to be licensed under this chapter and who shall fail to obtain the license required herein shall be liable, upon conviction thereof, to a fine not exceeding $500 or imprisonment for a term of 90 days, or both, for each day of the operation of such motion-picture theater without a license. A person other than a corporation violating any of the other provisions of this chapter shall, upon conviction thereof, be subject to a fine not exceeding $500 or imprisonment in the county jail for a period not exceeding 90 days, or both.
