A Municipal Court of the Township of Plumsted, in the County of Ocean, has been established pursuant to the provisions of N.J.S.A. 21:8-1, et seq.
The name of said Municipal Court shall be the "Municipal Court of the Township of Plumsted, in the County of Ocean."
The Municipal Court of the Township of Plumsted shall have a seal which shall bear the name of the Court.
There shall be a Judge of said Municipal Court who shall be appointed by the governing body of the Township of Plumsted. Said Municipal Court Judge shall serve for a term of three (3) years from the date of his appointment and until his successor is appointed and qualified. Any appointment to fill a vacancy caused other than by expiration of term shall be made for the unexpired term only.

Said Municipal Court of the Township of Plumsted and the Judge thereof shall have, possess and exercise all of the functions, powers, and duties and jurisdiction conferred by law upon said Court and Magistrate.
A. 
Pursuant to N.J.S.A. 2B:12-28 the Municipal Court Judge is authorized to require a person applying for representation by a Municipal Public Defender to pay a waivable application fee of not more than two hundred dollars ($200) to the municipality through the Municipal Court.

Position created. There is hereby created the position of Administrator of the Municipal Court of the Township of Plumsted.
B. 
Appointment and term of office. The Administrator of the Municipal Court shall be appointed by the governing body of the Township of Plumsted. Said Administrator shall serve for a term of three (3) years from the date of appointment and until a successor is appointed and qualified.
C. 
Duties. The Administrator shall perform such functions and duties as shall be prescribed for said Administrator by law, the rules applicable to Municipal Courts and by the Judge of the Municipal Court of the Township of Plumsted.

Position created. There is hereby created the position of Deputy Court Clerk of the Municipal Court of the Township of Plumsted.
B. 
Appointment and term of office. The Deputy Court Clerk shall be appointed by the governing body of the Township of Plumsted. Said Clerk shall serve for a term of one (1) year from the date of appointment and until a successor is appointed and qualified.
C. 
Duties. The duties of the Deputy Court Clerk shall be as follows:
(1) 
Assist the Municipal Court Administrator in performing such functions and duties of her office.
(2) 
Perform such functions and duties as shall be prescribed for said Deputy Court Clerk by law, the rules applicable to Municipal Courts and by the Judge of the Municipal Court.
(3) 
Perform all related work as required by the Municipal Court Administrator.
A. 
Position created. There is hereby created the position of Municipal Court Prosecutor.
B. 
Qualifications. The Municipal Court Prosecutor shall be a duly licensed attorney at law of the State of New Jersey.
C. 
Appointment and term of office. The Municipal Court Prosecutor shall be appointed by the governing body of the Township of Plumsted. He shall serve for a term of one (1) year and until his successor is appointed and qualified.
D. 
Duties. The Municipal Court Prosecutor shall appear in Municipal Court on behalf of the State of New Jersey of the Township of Plumsted in any case therein pending, upon the request of the Municipal Judge, the Chief of Police or directive of the governing body. He shall exercise the powers and duties assigned to such office by the statutes and court rules of the State of New Jersey.

Position created. There is hereby created the position of Public Defender.
B. 
Qualifications. The Public Defender shall be a duly-licensed attorney at law of the State of New Jersey.
C. 
Appointment and term of office. The Public Defender shall be appointed by the governing body. He shall serve for a term of one (1) year and thereafter until his successor has been appointed and qualified.
D. 
Duties. The Public Defender shall defend indigent persons in the Municipal Court of the Township of Plumsted upon being requested to do so by the Municipal Judge and shall perform such other duties as may be required by the rules of the New Jersey Supreme Court or state statute.
There shall be a Municipal Court Officer, who shall be appointed by the governing body, who shall serve for a term of one (1) year commencing January 1st of the year in which he/she is appointed.

A. 
The salaries for the Municipal Court Administrator and Deputy Court Clerk shall be fixed by the Salary Ordinance of the Township of Plumsted. Said salaries shall be paid in a similar manner as the salaries of other municipal officers are paid. Said salaries shall be in lieu of all fees, costs and other allowances.
B. 
The Municipal Court Judge, Municipal Prosecutor and Public Defender shall be paid in accordance with contracts entered into with the Township of Plumsted in accordance with the requirements of the Local Public Contracts Law.
The Municipal Court Officer shall receive an annual salary as established in the annual Salary Ordinance to be paid in the manner set forth therein. Under no circumstances is the Municipal Court Officer to work in excess of twenty (20) hours per week in that capacity and said Officer shall not be entitled to any employee benefits.

The governing body may provide for and appoint any addition clerical help or assistants to perform such functions and duties as prescribed by law, the rules applicable to municipal courts and by the Municipal Judges, as well as comply with all laws and regulations required for or directed towards the proper performance of their functions and duties.
