Any applicant for development, owner of property or person in possession of certain real property within the Township of Plumsted who has received approval from the Plumsted Township Zoning Board of Adjustment, the Plumsted Township Planning Board or the combined Planning/Land Use Board of the Township of Plumsted who, violates, or permits, suffers or allows the violation of the terms and conditions of such approval shall upon conviction thereof, be punishable by a fine of not more than one thousand dollars ($1,000.), by imprisonment for a term not to exceed ninety (90) days or by community service of not more than ninety (90) days, or any combination of fine, imprisonment, and community service as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense. If the owner, applicant for development or person in possession of said property, is other than an actual person, said entity shall be punished as any other corporate entity would under the Criminal Code of the State of New Jersey.

No person, agent, servant and/or employee of any applicant for development, the owner of any real property or person in possession of said real property, shall violate or permit the violation of the terms and conditions of any subdivision, site plan or variance approval previously received from the Plumsted Township Zoning Board of Adjustment, the Plumsted Township Planning Board or the combined Planning/Land Use Board of the Township of Plumsted. Such terms or conditions of approval may be contained within the resolution of approval of the respective Board, any documents incorporated therein by reference, any filed maps or deeds or any stipulations or representation placed on the record at the time the application was heard.
In addition thereto, any owner of property, applicant for development or person in possession of real property who shall violate or permit the violation of any terms or conditions of any conservation easement as part of an approval before the respective Land Use Board agency, shall be considered in violation of this section and in addition to any monetary fines authorized shall also be required to replace, on a tree for tree basis, the same size caliper and tree which was destroyed or removed in violation of said conservation easement.
