(A) No person, firm or corporation within the City limits shall burn
solid waste, refuse or rubbish, including construction waste, unless
a valid Department of Natural Resources permit is obtained, displayed
on-site and complied with, unless the specific burning is exempt from
state regulation. Any such permit shall specify the location, date
and conditions of burning.
(B) No person, firm or corporation within the City limits shall burn
commercial waste, household trash, paper products or food waste.
(C) No person, firm or corporation within the City limits shall burn
leaves, brush and yard waste, except when such burning is continually
supervised by an adult, and only when the prevailing circumstances
permit its being done without creating a fire hazard. No such burning
shall be conducted on breezy, gusty or windy days, nor during times
of dry conditions or drought. No person, firm or corporation within
the City limits shall pile or accumulate waste, rubbish or refuse
of any type for burning if it causes odors, noxious fumes, an unsanitary
condition or a fire hazard.
(D) Any private property used for the conduct of such activity is declared
a nuisance to the health and safety of the public.
