A. The City of O'Fallon hereby adopts the
most recent Building Valuation Data issued by the International Code
Council, which shall be filed with and available at the office of
the Building and Code Enforcement Manager. Whenever the International
Code Council issues an updated or revised Building Valuation Data
report, the Building and Code Enforcement Manager is hereby authorized
to administratively adopt the new valuation and utilize it for the
purposes hereinafter provided if the Manager is satisfied in the exercise
of the Managers administrative discretion that such data is reasonable
with respect to construction in the O'Fallon area. Additionally, where
the Building Valuation Data does not include cost estimation based
on a particular type of construction or project, the City of O'Fallon
hereby adopts the current data supplied by the Marshall Valuation
Service as published by the Marshall and Swift Publication Company,
Los Angeles, California.
B. The City of O'Fallon hereby adopts permit
fee multiplier of .0065 for issuance of all building permits for use
in determining fees based upon cost of construction as hereinafter
provided.
C. The fees for plan review and building permits for all new commercial and residential construction, and all new additions to commercial and residential construction, and any and all other permits governed by the codes adopted in Articles
I and
X of this Chapter shall be calculated as follows: the applicable Cost of Construction shall be multiplied by the factor adopted in Subsection
(B) above to determine the building permit fee, provided, however, that there shall be minimum permit fees as adopted in Subsection
(E). A minimum charge of twenty-five dollars ($25.00) or a charge of twenty percent (20%) of the permit fee, whichever is greater, shall be collected for the plan examination and administrative processing of a building permit application that has been canceled or abandoned by the applicant for any reason prior to a building permit being issued.
D. Rental Occupancy Permit Fees. Fees shall
be paid prior to scheduling an occupancy inspection. One (1) re-inspection
shall be provided for each initial compliance inspection within ninety
(90) days of the date of the original inspection. Each additional
re-inspection shall be thirty-five dollars ($35.00). Fees are as follows:
1.
Single-family: Seventy-five dollars
($75.00).
2.
Multi-family: Fifty dollars ($50.00)
per unit.
E. The minimum building permit fees for the
following construction shall be as specified herein:
1.
A minimum fee of twenty-five dollars
($25.00) shall apply to all of the following permits:
a.
Fences and similar barriers.
2.
A minimum fee of fifty dollars ($50.00)
shall apply to all of the following permits:
c.
Residential furnace/air conditioner.
d.
Residential water heater.
3.
A minimum fee of seventy-five dollars
($75.00) shall apply to all of the following permits:
4.
A minimum fee of one hundred dollars
($100.00) shall apply to all of the following permits:
e.
Residential remodel/kitchens/bathrooms.
f.
Miscellaneous construction not defined
elsewhere.
g.
Flag poles over thirty-five (35)
feet.
h.
Commercial fire suppression system/sprinklers/hoods.
i.
Communication tower antenna installation.
5.
A minimum fee of one hundred fifty
dollars ($150.00) shall apply to all of the following permits:
g.
Commercial tenant finish.
h.
Temporary structures/tents.
6.
A minimum fee of two hundred fifty
dollars ($250.00) shall apply to all of the following permits:
a.
Commercial new buildings.
f.
Multi-family residential.
F. "Master Plans" for new residential construction
that undergo a plan review shall be charged twenty percent (20%) of
the total permit fee. Each subsequent permit thereafter issued by
the Division of Building and Code Enforcement shall be charged an
eighty percent (80%) permit fee that uses the approved Master Plans
without modification to build the same model or product at or on different
lots or parcels.
G. In calculating fees based on total cost
of construction, whenever the Building and Code Enforcement Manager
believes information relating to the total cost of construction provided
by an applicant is inaccurate, unrealistic, incomplete or insufficient
for the work involved, the Manager may require additional information,
including, but not limited to, copies of signed contracts, and/or
may utilize such figures which will, in the Managers professional
experience and judgment, more accurately reflect the value of the
materials to be utilized and the work to be performed.
H. "Estimated cost of construction," as used
in this Subsection, means the higher of the following: estimated cost
of construction as stated by applicant for permit, the square footage
cost based on the ICC Building Valuation Data, or the cost of labor
and material for the work to be permitted as estimated by a plans
examiner of the Division of Building and Code Enforcement according
to current data supplied by the Marshall Valuation Service as published
by the Marshall and Swift Publication Company, Los Angeles, California.
I. The fees provided in this Section shall
include one (1) original inspection of the relevant work and one (1)
re-inspection. Any additional re-inspections reasonably required to
complete oversight and approval of the relevant work will be charged
to the permit holder at the rate of thirty-five dollars ($35.00) per
inspection as an additional fee.
J. The fees provided in this Section shall
include one (1) plan review of the relevant work and one (1) re-review.
Any additional re-reviews reasonably required to complete permit approval
and issuance will be charged to the permit holder at the rate of twenty-five
dollars ($25.00) per residential permit review and one hundred dollars
($100.00) per commercial review as an additional fee.
K. The Building and Code Enforcement Manager
at his/her discretion may issue integrated building, plumbing, electrical
and/or mechanical permits on a single permit application. The total
integrated permit fee shall be the cumulative total of the fees applicable
to each permit and/or plan review separately.
L. Permit applications shall include the name,
signature and license number of the appropriate licensed subcontractor.
Any change in the identity of the named subcontractor after issuance
of the permit must be made, in writing, noting the project, owner,
subcontractor, license number and shall result in the assessment of
a transfer fee of fifty dollars ($50.00) for each change.
M. All fees must be paid in full prior to
issuance of the relevant permit. Any additional fees charged must
be paid in full before the relevant work being approved and/or occupancy
of the relevant construction is permitted.
