It has been determined that the use of fertilizers containing phosphorous and their eventual presence in storm water runoff constitutes a threat to the quality of surface water within the borough, which is inimical to the general welfare. It is the purpose of this chapter to decrease the use in the borough of fertilizers containing phosphorous.
A. 
No person, firm or corporation shall apply fertilizer to lawns within the Borough of Mount Arlington that contains more than 0.5% phosphorous.
B. 
Lawn fertilizer application shall not be applied when the ground is frozen.
C. 
No person shall deposit leaves or other vegetative materials on roads or within or near any lake or storm water drainage system.
D. 
Applications of fertilizer of any kind shall not be made within 10 feet of any wetland or body of water.
E. 
Exemptions: Newly established turf areas shall not be limited by this chapter for the first growing season.
F. 
Penalties for violation. Any person violating any of the provisions of this section shall, upon conviction thereof, be punishable by a fine of not more than $2,000 or imprisonment for up to 90 days or a period of community service for not more than 90 days, or any combination thereof.
