The owner, occupant or person in charge of each and every dwelling house, store or other building and/or vacant lot(s) in the Borough of Mount Arlington shall, within 24 hours after every fall of snow or hail or the formation of ice upon the sidewalks in front and/or abutting upon such house, store or other building and/or vacant lot(s) remove or cause the same to be removed from the sidewalks adjacent to such dwelling house, store, building and/or vacant lot(s).
It shall be unlawful after the snow has been plowed by a snowplow or removed by a snow loader or other apparatus to throw any snow from sidewalks into any street or thoroughfare, where cleared.

Anyone violative of this chapter shall, upon conviction thereof, be liable to the penalty convicted by Chapter 1, Article III.

Due to the topography of the properties, and the distance of the houses on such properties from the sidewalks, and the resulting public safety issues involved in requiring the owners of the dwellings abutting those sidewalks to remove snow and ice from those sidewalks, the following properties located within the Borough of Mount Arlington shall be exempt from the requirements set forth in section §137-1 of this Chapter that can be interpreted to require them to remove snow and ice from sidewalks, along the roadway frontages noted below, located on or adjacent to their properties. In no instance shall property owners be relieved from removing snow and ice from sidewalks along a roadway which a driveway to the property intersects.

Block 121, Lot 1, 2 Richard Drive West – Windermere Avenue frontage shall be exempt.
Block 121, Lot 2, 4 Richard Drive West – Windermere Avenue frontage shall be exempt.
Block 121, Lot 3, 6 Richard Drive West – Windermere Avenue frontage shall be exempt.

A. 
Findings. The Borough hereby determines that in its sole opinion the travel on certain streets present in the Borough warrant the expenditure of municipal funds for the purposes of basic maintenance, snow plowing and ice removal.
B. 
Extent of Borough obligation. Nothing in this section shall be deemed or interpreted to constitute either a dedication of the street to the public or an acceptance by the Borough of the street as a public street. The purpose of this section is to permit the Borough to voluntarily perform certain basic maintenance on the street and do certain snow plowing and ice removal on the street without any further obligation on the Borough's part either to continue to maintain the street or continue to plow the street or remove ice.
