[1985 Code § 28-1.1]
As used in this section:
ALUMINUM CANS
Shall mean cans made entirely of aluminum which were used
to hold beverages. Specifically excluded are other aluminum products
such as foil, pie pans and aluminum siding.
BATTERIES (DRY CELL)
Shall mean a type of battery, coin cylindrical, rectangular
or other shaped, enclosed or sealed container consisting of a combination
of two or more voltaic or galvanic cells, electrically connected to
produce electric energy, composed of lead, lithium, manganese, mercury,
mercuric oxide, silver oxide, cadmium, zinc, copper or other metals,
or any combination thereof, and designed for commercial, industrial,
medical, institutional or household use, including any alkaline, manganese,
lithium, mercury oxide, silver oxide, zinc-air or zinc-carbon battery,
nickel, cadmium rechargeable battery or sealed lead rechargeable battery.
BATTERIES (LEAD ACID)
Shall mean a lead acid electric storage battery designed
for use in motor vehicles, aviation equipment or marine vessels.
BI-METAL CANS
Shall mean cans made of aluminum and another metal, or cans
manufactured from two metals, not necessarily aluminum.
BUSINESS OR COMMERCIAL
Shall mean any nonresidential building or establishment including,
but not limited to, those used for retail, wholesale, offices, professional
services, shipping and receiving areas, and cafeterias.
CHIPBOARD
Shall mean paperboard made from wastepaper, such as cereal
boxes.
COMPOST
Shall mean a mixture that consists largely of decayed organic
matter and is used for fertilizing and conditioning land.
CONSTRUCTION/DEMOLITION DEBRIS
Shall mean recyclable components of the construction/demolition
debris waste stream, including, but not limited to, concrete, brick,
block, asphalt, asphalt-based roofing scrap, ferrous and nonferrous
metals, piping, nonchemically treated wood, and such other items as
may hereafter be designated by the Borough's Recycling Coordinator.
CONTAINERS
Shall mean reusable plastic or metal cans not exceeding 30
gallons in size, or a container issued by the Recycling Coordinator.
CONTAMINATED
Shall mean all those items normally of a recyclable nature
which contain a substance such as paint, turpentine, or animal droppings
that render the material unmarketable as a recyclable.
DESIGNATED MATERIALS
Shall mean those recyclable materials listed in this definition
and shall include any additional materials stipulated by resolution
of the Borough Council for recycling, including, but not limited to,
such materials as plastics, oil, tires, organics and car batteries.
When so designated for recycling, the designated materials shall be
subject to the terms of this section.
FOOD WASTE
Shall mean discarded food product or organic materials used
in preparing, preserving or serving food (Not applicable to households).
GARDEN DEBRIS
Shall mean all types of garden debris such as herb, fruit,
flower and vegetable plants, shrub and tree branches, not to exceed
four feet in length and two inches in diameter. Garden debris shall
not include logs or stumps.
GLASS
Shall mean bottles and jars made of silica, soda ash and
limestone, being transparent or translucent and breakable. Specifically
excluded from this category are plastics and any other glass products
such as window or plate glass, crushed glass, drinking glasses and
ceramics.
HIGH-GRADE PAPER
Shall mean office papers of high quality which do not have
a glossy finish, including but not limited to computer, letterhead,
ledger and photocopy paper.
INSTITUTION
Shall mean an established organization or foundation dedicated
to public service or culture including but not limited to religious,
educational, health care, and governmental establishments.
JUNK MAIL
Shall mean magazines, coupons, envelopes (with or without
cellophane windows), color inserts, direct mail ads, flyers, brochures,
forms, notebook paper, school paper, computer paper and NCR paper.
LEAVES
Shall refer to tree leaves, shrubs and tree branches not
to exceed four feet in length and two inches in diameter. The term
shall not include logs or stumps.
METALS
Shall mean all metals not covered under other descriptions.
Metals shall not include porcelain.
NEWSPAPERS
Shall mean newsprint-grade paper. Soiled papers are not included.
PERSONS
Shall mean all individuals, partnerships, corporations, owners,
tenants, lessees, firms, societies, schools, churches and associations,
either profit or nonprofit, within the Borough.
PLASTIC
Shall mean all plastic containers and film with the exception
of those containing contaminated material such as motor oils and pharmaceuticals.
RECYCLABLE
Shall mean all materials designated by this section or future
ordinance to be separated from solid waste.
RECYCLING
Shall mean any process by which materials which would otherwise
become solid waste are collected, separated or processed and returned
to the economic mainstream.
RECYCLING COORDINATOR
Shall mean the person appointed by the Borough Manager who
shall be authorized to coordinate the Borough's Recycling Program
and assist with the enforcement of the provisions of this section
and the rules and regulations promulgated hereafter.
SOLID WASTE
Shall mean all garbage and rubbish not designated by the
Borough for recycling.
SOURCE REDUCTION
Shall mean preventing the actual generation of waste, eliminating
the need to manage that material later as recyclable or nonrecyclable
waste and therefore reducing the economic and environmental impact
of both recycling and waste disposal.
SOURCE SEPARATION
Shall mean keeping recyclable materials separate and apart
from residential, commercial and institutional solid waste for the
purposes of collection, disposition and recycling.
TIRES
Shall mean the external rubber-and-fabric covering of a pneumatic
tire for automobiles and trucks.

It shall be mandatory for all persons, residential, institutional and commercial, to source separate newspapers, magazines, corrugated cardboard, glass containers, high-grade paper and aluminum and bi-metal containers from all other recyclable materials as designated by ordinance or resolution of the Borough Council and from all other solid waste products in or at any premises in the Borough in a manner described by the Borough Council. This shall be done in the manner described in subsection
20-1.3.

At the option and expense of persons required to separate recyclables,
the following materials shall be accepted at the Borough Recycling
Center during the days and hours set by the Recycling Coordinator:
e. Aluminum and bi-metal containers;
f. Tires (passenger car only);
i. Scrap ferrous metal (to be deposited at Borough Garage); and
j. Other materials designated by resolution of the Borough Council.

At such times when it may become necessary for the Borough to
charge residents for certain recycling services, charges shall be
recommended by the Recycling Coordinator and be subject to approval
by the Borough Council.

All commercial establishments, including restaurants and taverns,
shall segregate corrugated materials and office paper and make private
arrangements for its disposal.

All commercial, institutional, multi- or single-family developments
which are not serviced by municipal recycling collection systems shall
submit recycling documentation on a quarterly basis to the Borough
Recycling Coordinator. The schedule is as follows:

The Municipal Recycling Coordinator will compile all recycling
documentation and report to the County Recycling Coordinator on a
quarterly basis by the 15th of the month during which the reports
are due.
Recyclable materials placed at the curb or recycling depot are the property of the Borough of Ringwood or its authorized agent. It is a violation of this section for any person who is not authorized by the Borough to collect or pick up or cause to be collected or picked up any recyclables. Each collection in violation hereof shall constitute a separate and distinct offense punishable as provided in subsection
20-1.12.

Any person who is an owner, lessee or occupant may donate or sell recyclable materials to any person, partnership or corporation (whether operating for profit or not for profit) as long as the recycling individual or company submits documentation to the Borough Recycling Coordinator as described in subsection
20-1.7.

The Borough Manager, Recycling Coordinator, Police Department,
Health and Sanitation Officers, Director of Public Works, and Construction
Official and/or their designated agent(s), are authorized and directed
to enforce all provisions of this section including inspection and
penalties for noncompliance.

Any person, firm or corporation who violates or neglects to
comply with the regulations set forth in this section or any regulations
promulgated pursuant thereto shall, upon conviction, be subject to
one or more of the following:
a. The minimum for a first offense shall not be less than $100 and will
not exceed a maximum of $1,250;
b. Imprisonment for a term not exceeding 90 days; or
c. Community service not exceeding 90 days.
Each and every day that a violation continues shall be considered
a separate offense.

The enforcement agent(s) and their designated agent(s) shall
be responsible for the inspection of solid waste and/or recyclables
in all sectors in order to determine any noncompliance with this section.
These inspections will be made on a random basis, at a frequency of
at least once per month per collection route. The enforcement agent
may, in his/her discretion, post warning stickers for first violations.
The County Health Department or its designee shall also be authorized
to enforce the provisions of this section.

It shall be the responsibility of the Borough to adopt source
reduction practices (the prevention of the generation of waste at
the beginning of a process or service) as the first step in solid
waste management which shall include self-audit waste surveys to be
performed by the Borough and the commercial industrial sectors of
the Borough. Waste reduction plans shall be submitted to the County
Recycling Coordinator and to the Municipal Recycling Coordinator.
The Municipal Recycling Coordinator shall submit documentation
indicating compliance with yearly municipal recycling certification
requirements to the County Recycling Coordinator by April 15th of
each year with information on the previous calendar year's activities
for certification purposes.

Leaves and garden debris may be deposited at the Department
of Environmental Protection-licensed compost area throughout the year
by Borough residents and landscaping contractors.

No person shall dump, abandon, leave or place leaves or garden
debris on any public or municipally-owned property in the Borough
except as provided in this section.

Permits for the dumping or disposal of leaves and garden debris
shall be issued through the office of the Department of Public Works.
a. Residential Permits. Residents and homeowners of the Borough will
not be charged a permit fee.
b. Commercial Permits. Commercial permits shall be issued only to Ringwood-based
landscaping businesses and shall be valid only for disposal of leaves
and garden debris coming from, or generated on, property located in
the Borough of Ringwood. Commercial applicants shall produce notarized
proof of a Ringwood business location.
The commercial permit fee shall be $500 per year.

Hours for dumping at the compost facility shall be designated
by the Recycling Coordinator.

No dumping of any containers or plastic bags at the compost
facility shall be permitted. All leaves and garden debris shall be
removed from such containers or plastic bags before dumping.

Any person or persons violating the terms of this section shall be subject to the penalty stated in Chapter
1, Section
1-5 for each offense.

The purpose of this section is to establish a yard waste collection
and disposal program in the Borough of Ringwood so as to protect public
health, safety and welfare, and to prescribe penalties for the failure
to comply.

For the purpose of this section, the following terms, phrases,
words, and their derivations shall have the meanings stated herein
unless their use in the text of this section clearly demonstrates
a different meaning. When not inconsistent with the context, words
used in the present tense include the future, words used in the plural
number include the singular number, and words used in the singular
number include the plural number. The word "shall" is always mandatory
and not merely directory.
CONTAINERIZED
Shall mean the placement of yard waste in a trash can, bucket,
bag or other vessel, such as to prevent the yard waste from spilling
or blowing out into the street and coming into contact with stormwater.
PERSON
Shall mean any individual, corporation, company, partnership,
firm, association, or political subdivision of this State subject
to municipal jurisdiction.
STREET
Shall mean any right-of-way, including any street, avenue,
boulevard, road, parkway, viaduct, drive, or other way, which is an
existing State, County, or Municipal roadway, and includes the land
between the street lines, whether improved or unimproved, and may
comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas,
and other areas within the street lines.

The provisions of this section shall be enforced by the Police
Department, Code Enforcement Officer and/or the Recycling Coordinator
of the Borough of Ringwood.

Any person(s) who is found to be in violation of the provisions
of this section shall be subject to a fine not to exceed $2,000.
