As used in this chapter, the following terms shall have the meanings indicated:
SWIMMING POOL
A body of water, artificially constructed in whole or in part, whether permanently constructed or of the portable type, having at any point a depth of more than 18 inches below the grade or level of the ground area surrounding it or any above-surface pool having a depth of more than 30 inches and located out of doors on a lot or lots and designed, established and constructed for swimming or bathing purposes for an individual for use of the members of the household and guests.
WADING POOL
Includes any shallow pool not included above.
The Township of Raritan hereby adopts and incorporates by reference the 2018 International Swimming Pool and Spa Code as enforced by this chapter. The provisions of this chapter shall apply to swimming pools existing on November 27, 1972, and swimming pools constructed after November 27, 1972.
The following shall not be considered a swimming pool under this chapter, notwithstanding the possibility that all or any of the hereinafter named may occasionally or regularly be used for bathing or swimming, and the hereinafter named are expressly exempted from this chapter:
A. 
Any and all indoor swimming pools.
B. 
Any and all rivers, streams, relocated streams, lakes, natural ponds, or other natural waterways.
C. 
Any and all man-made lakes and ponds having a normal water surface area of more than 1/2 of an acre.
D. 
Any and all man-made drainage ditches, mill races and other similar waterways.
E. 
Any and all man-made fish ponds having a depth of not more than 18 inches.
F. 
Any and all wading pools having a depth of not more than 18 inches.
G. 
Any and all aboveground inflated plastic wading pools and other aboveground wading pools of similar flexible side wall construction having a depth of not more than 18 inches.
H. 
Any and all swimming pools which are commercially operated as a business and as a permitted use or existing nonconforming use under the terms of Chapter 296, Land Development.
Fencing of all pools in any zone shall be in accordance with the development regulations of the Township.
It shall be the duty of the Land Use Enforcement Officer of the Township or his or her designee to enforce the provisions of this chapter.
