This article shall be known as the "Commercial Zone Parking
Regulations."
The terms set forth below in this §
305-68, when used within Article
IX, shall have the following meanings:
ALL-NIGHT PARKING
Any parking of a vehicle within the commercial parking zone
between the hours of 2:00 a.m. and 6:00 a.m. of the same day.

BOROUGH
The Borough of Towanda of the County of Bradford and State
of Pennsylvania.
CAR STOP
An object whose primary purpose is to constitute a physical
obstruction to prevent any vehicle from moving in a certain direction
beyond a certain point.
CURB
A raised street border usually composed of granite, concrete
or asphalt, which guides, manages or retains objects such as vehicles
or water.
CURBLINE
The area which borders a street where a curb would logically
be placed if a curb were to be constructed.
METERED PARKING SPACE
A parking space for which a user fee is charged based upon
the duration of parking and paid at the time of parking by use of
an on-site meter or other payment collection device.

PARK
To place a vehicle in a parking space.
PARKING DAY
That time between 8:00 a.m. and 5:00 p.m. every Monday through
Friday except for New Year's Day, Memorial Day, the Fourth of July,
Labor Day, Thanksgiving and Christmas.
PARKING DAY PERMIT
A permit issued for use of a permit parking space during
a parking day, except that for a permit parking space in the public
parking garage only, the use is permitted at all times and is not
limited to a parking day.

PARKING SPACE
A section of a street or municipal public parking area identified
by lines or other markings which is intended for vehicular parking.
PARKING SPACE ENFORCEMENT OFFICER
Any member of the Towanda Borough Police Department and any person appointed by the Borough Council as a parking space enforcement officer with the authority to enforce this Article

PERMIT HOLDER
Any person who owns a valid permit to park a vehicle in a
permit parking space.
PERMIT INVITEE
Any person who has permission from a permit holder to park
a vehicle in a permit parking space which is subject to the permit
holder's permit.
PERMIT PARKING SPACE
A parking space intended for vehicular parking by permit
only. A permit parking space shall be a free parking space unless
and until a person has acquired a permit pertaining to that parking
space.
PERSON
Any individual, corporation, company, partnership, association,
or other legally constituted entity.

PUBLIC PARKING GARAGE
The three-tiered parking structure located at 11 State Street
containing 193 parking spaces.

PUBLIC PARKING SPACE
A parking space that is a permit parking space, three-hour
parking space, metered parking space or Second Street parking space.

REGISTERED OWNER
The person named as the owner of a vehicle on a government-issued
vehicle registration or certificate of title.

RESIDENT PARKING PERMIT
A permit issued to a resident of the Borough for use of a
permit parking space at all times.

RESIDENT PARKING SPACE
A parking space that is intended for vehicular parking by
a designated resident and his invitees.
SECOND STREET RESIDENT
Any person who resides in the Borough along Second Street
between Maple Street and Elizabeth Street.
SECOND STREET RESIDENT INVITEE
Any person who has permission from a Second Street resident
to park a vehicle in a Second Street resident parking space.
THREE-HOUR PARKING SPACE
A free parking space intended for vehicular parking for up
to three continuous hours during a parking day.

VEHICLE
That in or on which a person or thing is or may be carried
on land from one place to another.
There is established a commercial parking zone.
There are established municipal public parking areas.

A. Within the commercial parking zone on streets and municipal public
parking areas, the following three-hour parking spaces, permit parking
spaces, metered parking spaces, resident parking spaces and Second
Street resident parking spaces are established:
(1) Moving in a north to south direction, the following streets shall
have the following types of public parking spaces:
(a)
Second Street between Maple Street and State Street: nine Second
Street resident parking spaces and five permit parking spaces on the
east side of the street and seven Second Street resident parking spaces
and six permit parking spaces on the west side of the street.
(b)
Second Street between State Street and Poplar Street: six Second
Street resident parking spaces and five permit parking spaces on the
west side of the street and seven Second Street resident parking spaces
and four permit parking spaces on the east side of the street.
(c)
Second Street between Poplar Street and Pine Street: Second
Street resident parking spaces on both the west and east sides of
the street.
(d)
Second Street between Pine Street and Bridge Street: nine permit
parking spaces on the west side of the street and two Second Street
resident parking spaces, four permit parking spaces and seven Second
Street resident parking spaces on the east side of the street.
(e)
Second Street between Bridge Street and Elizabeth Street: Ten
Second Street resident parking spaces, 18 permit parking spaces and
three Second Street resident parking spaces on the west side of the
street and 32 Second Street resident parking spaces on the east side
of the street.
(f)
Main Street between Lombard Street and Maple Street: nine permit
parking spaces and five three-hour parking spaces on the west side
of the street and no public parking spaces on the east side of the
street.
(g)
Main Street between Maple Street and State Street: nine three-hour
parking spaces on the west side of the street and no public parking
spaces on the east side of the street.
(h)
Main Street between State Street and Poplar Street: three-hour
parking spaces on both the west and east sides of the street.
(i)
Main Street between Poplar Street and Pine Street: three-hour
parking spaces on both the west and east sides of the street.
(j)
Main Street between Pine Street and Bridge Street: three-hour
parking spaces on both the west and east sides of the street.
(k)
Main Street between Bridge Street and Washington Street: three-hour
parking spaces on both the west and east sides of the street; however,
on the east side of Main Street immediately prior to the intersection
of Main Street and Bridge Street, there shall be a fifteen-minute
loading zone.
(l)
Main Street between Washington Street and Elizabeth Street:
three-hour parking spaces on both the west and east sides of the street.
(m)
Main Street between Elizabeth Street and Means Street: no public
parking spaces on the west side of the street and three-hour parking
spaces on the east side of the street.
(n)
Merrill Parkway between State Street and Park Street: four permit
parking spaces on the east side.
(o)
Merrill Parkway between Park Street and Court Street: four permit
parking spaces on the east side.
(p)
Merrill Parkway between Park Street and Pine Street: three permit
parking spaces on the west side.
(q)
Merrill Parkway between Pine Street and Bridge Street: permit
parking spaces on both the west and east sides of the street.
(r)
Merrill Parkway between Bridge Street and Washington Street:
no public parking spaces on the west side of the street and 10 permit
parking spaces on the east side of the street.
(s)
Merrill Parkway between Washington Street and Elizabeth Street:
eight permit parking spaces on the west side and 12 permit parking
spaces on the east side.
(t)
Merrill Parkway between Elizabeth Street and Bridge Street:
19 permit parking spaces on the west side of the street and no public
parking spaces on the east side of the street.
(u)
Merrill Parkway between Elizabeth Street and Farley Connector:
six permit parking spaces on the east side.
(2) Moving in a west to east direction, the following streets and municipal
public parking areas shall have the following types of public parking
spaces:
(a)
Lombard Street between Second Street and Main Street: permit
parking spaces on both the north and south sides of the street.
(b)
Maple Street between Second Street and Main Street: eight permit
parking spaces and seven three-hour parking spaces on the south side
of the street and no public parking spaces on the north side of the
street.
(c)
State Street between Second Street and Main Street: no public
parking spaces on the south side of the street and three permit parking
spaces, one resident parking space and four permit parking spaces
on the north side of the street.
(d)
Poplar Street between Second Street and Main Street: four permit
parking spaces on the south side of the street and no public parking
spaces on the north side of the street.
(e)
Pine Street between Second Street and Main Street: five permit
parking spaces and two three-hour parking spaces on the south side
of the street and no public parking spaces on the north side of the
street.
(f)
Bridge Street between Second Street and Main Street: three three-hour
parking spaces, two permit parking spaces and two resident parking
spaces on the north side of the street and no public parking spaces
on the south side of the street.
(g)
Washington Street between Second Street and Main Street: three-hour
parking spaces on both the south and north sides of the street.
(h)
Elizabeth Street between Second Street and Main Street: four
resident parking spaces, three permit parking spaces and two three-hour
parking spaces on the south side of the street and no public parking
spaces on the north side of the street.
(i)
State Street between Main Street and Merrill Parkway: six three-hour
parking spaces on the south side of the street and three three-hour
parking spaces on the north side of the street.
(j)
Park Street between Main Street and Merrill Parkway: three-hour
parking spaces and one handicapped parking space on both the south
and north sides of the street.

Court Street between Main Street and Merrill Parkway: 23 metered
parking spaces.

Pine Street between Main Street and Merrill Parkway: 14 metered

(m)
Bridge Street between Main Street and Merrill Parkway: 12 three-hour
diagonal parking spaces, four permit parking spaces and one loading
zone on the south side of the street, no public parking spaces on
the north side of the street, and five permit parking spaces on the
K-turn area at the east end of Bridge Street.

Washington Street between Seebick Alley Street and Merrill Parkway:
14 metered parking spaces.

(o)
Elizabeth Street between Main Street and Merrill Parkway: no
public parking spaces on the south or north sides of the street.
(p)
Washington Street off-street municipal public parking area:
all parking spaces are permit parking spaces.
(3) Within the public parking garage, all parking spaces located on the
ground level shall be metered parking spaces, and all parking spaces
located on the second and third levels shall be permit parking spaces.
B. Within the commercial parking zone, except on Second Street between
Maple Street and Elizabeth Street, all parking spaces shall be free
parking spaces unless designated as permit parking spaces or metered
parking spaces.

A. Three-hour parking. During a parking day, it shall be unlawful for
the registered owner of a vehicle to park, or cause or allow that
vehicle to be parked, in one or another three-hour parking space in
excess of three consecutive hours calculated from the time when the
vehicle is first parked.

B. Permit parking space. It shall be unlawful for the registered owner
of a vehicle to park, or cause or allow that vehicle to be parked,
in a permit parking space unless:
(1) The registered owner is a permit holder for that parking space or
a permit invitee of that permit holder; or
(2) The vehicle is parked in a parking space for which a parking day
permit is in effect and it is not a parking day.
C. Second Street resident parking space. It shall be unlawful for the
registered owner of a vehicle to park, or cause or allow that vehicle
to be parked, in a Second Street resident parking space unless the
registered owner is a Second Street resident or Second Street resident
invitee.
D. Use of unauthorized areas for parking. It shall be unlawful for the
registered owner of a vehicle to park, or cause or allow that vehicle
to be parked, on any street or municipal public parking area within
the commercial parking zone:
(1) Anywhere other than within a parking space; or
(2) Anywhere designated by an adjacent sign or by painted pavement, curb
or sidewalk markings as an area where parking is prohibited.
E. All-night parking. It shall be unlawful for the registered owner
of a vehicle to park, or cause or allow that vehicle to be parked,
on any street within the commercial parking zone at any time between
the hours of 2:00 a.m. and 6:00 a.m.:
(1) During any Monday or Friday; or
(2) Whenever four or more inches of snow have accumulated on the street
within five feet of that parked vehicle.
F. Position of parked vehicle. It shall be unlawful for the registered
owner of a vehicle to park, or cause or allow that vehicle to be parked:
(1) In a parallel parking space when the front of the vehicle is not
facing in the same direction as the direction of travel of the traffic
lane on which the parking space abuts; or
(2) In a diagonal parking space when the front of the vehicle is not
facing toward the curb, curbline or car stop; or
(3) In any parking space unless the vehicle is positioned entirely within
the lines of the parking space.
G. Loading zones. It shall be unlawful for the registered owner of a
vehicle to park, or cause or allow that vehicle to be parked, in a
loading zone when:
(1) The vehicle is not positioned entirely within the lines of the loading
zone; or
(2) Loading or unloading is not occurring; or
(3) The vehicle is parked in a loading zone in excess of 30 continuous
minutes.

H. Metered parking. It shall be unlawful for the registered owner of
a vehicle to park, or cause or allow that vehicle to be parked, in
a metered parking space when:
(1) The user fee has not been paid; or
(2) The time for which the user fee was paid is expired.
I. Parking spaces for disabled persons. It shall be unlawful for the
registered owner of a vehicle to park, or cause or allow that vehicle
to be parked, in any parking space designated by words or international
symbol on an adjacent sign or on painted pavement as a parking space
reserved for use by disabled persons unless that registered owner
is a disabled person or person assisting a disabled person. For purposes
of this section, a disabled person is a registered owner to whom an
official currently valid license plate or placard indicating disabled
status has been issued.

A. Any person who violates any subsection of §
305-74 of this Article
IX commits a summary offense and, upon conviction, shall be sentenced to pay the costs of prosecution and a fine as follows:
(1) For a violation of §
305-74A,
B,
C,
D,
E,
G,
H, or
I, a fine of $30 shall be assessed.
(2) For a violation of §
305-74F, a fine of $5 shall be assessed.
B. Any person convicted of a violation of any section of this Article
IX who willfully fails to pay the costs of prosecution and any fine imposed shall be sentenced to imprisonment for not more than two days.

Before a citation is issued to any person for a violation of any section of this Article
IX, the parking space enforcement officer shall at the time of violation place on the vehicle a written notice stating the date and time of the violation, the date and time of the notice, the section of this Article
IX that was violated, the street name or municipal parking area location where the vehicle is parked at the time of violation, the license number of the vehicle, and the fine due upon conviction after issuance of a citation.

A. No citation for violation of any section of this Article
IX shall issue to any person who pays in full the fine stated on the notice mandated by §
305-76 of this Article
IX within 14 days of the date and time of the violation stated on the notice by:
(1) Depositing such payment in a Borough Fine-o-meter box; or
(2) Making such payment in person at the Borough municipal offices at
724 Main Street during regular business hours; or
(3) Making such payment online at www.towandaborough.org.
B. For purposes of this section, the first day of the fourteen-day period shall be the date of the violation stated on the notice mandated by §
305-76 of this Article
IX, and the last day shall be the 13th day thereafter.
Fine-o-meters for receipt of payment of fines collectible under
this article shall be located on Main Street in the Borough.
Any member of the Borough Police Department and any person appointed
by the Borough Council as a parking space enforcement officer may
enforce this article.

A. Any person defending against prosecution for violation of §
305-74B of this Article
IX on the basis of invitee status shall have the burden of proving by a preponderance of the evidence that he or she was a permit parking invitee at the time of the alleged violation.
B. Any person defending against prosecution for violation of §
305-74C of this Article
IX on the basis of invitee status shall have the burden of proving by a preponderance of the evidence that he or she was a Second Street resident invitee at the time of the alleged violation.

A. The following permits may be obtained for a permit parking space, subject to the specific use conditions permitted for such parking space and all other provisions of this Article
IX:
(1) Parking day permit: a permit which allows use of the parking space
during parking days only, except that for a permit parking space in
the public parking garage only, the use is permitted at all times
and is not limited to a parking day;
(2) Resident parking permit: a permit which allows use of the parking
space every day by a resident of the Borough;
(3) Special construction vehicle permit: a permit which allows use of the parking space under the provisions of §
305-82B of this Article
IX.
B. A permit for a permit parking space may be obtained by completing
an application in person at the Borough municipal offices at 724 Main
Street or online at www.towandaborough.org and paying the required
fee. Permits shall be issued subject to the following:
(1) Permits shall be issued to qualifying applicants in chronological
order determined by the date and time an application is submitted
and the required fee is paid.
(2) A holder of an active permit parking space permit may renew the permit
at any time while the permit is valid.
C. A special parking permit may be granted to a contractor who holds
a valid building permit and is actively working anywhere within the
commercial parking zone to allow parking of construction vehicles.
The permit shall be issued at the discretion of the Borough parking
space enforcement officer or Borough code enforcement official.

The following user fees shall be paid in advance for use of
the following public parking spaces:
A. Public parking garage:
(1) Ground level metered parking spaces: $0.50 per hour.
(2) Second and third level parking day permit parking spaces: $40 per
month.
B. Second Street, Washington Street or Washington Street off-street
municipal public parking area parking day or resident parking permit
spaces: $20 per month.
C. All other permit parking spaces: $30 per month, except that if the
permit parking space is designated as reserved for use by disabled
persons, the user fee shall be $75 per month.

D. Special construction vehicle permit: $5 per day.

A. No person holding a permit parking space permit shall sell, assign
or transfer the permit for value to any other person. It shall not
be a violation of this section for a parking space permit holder to
allow a permit invitee free use of the parking space for which the
permit is issued.
B. Any permit parking space permit that has been sold, assigned or transferred in violation of Subsection
A shall be null and void.

The Borough Council, by resolution, may from time to time amend the number, type and location of public parking spaces, the location of no-parking areas, the user fees for the use of public parking spaces and the penalties for violations set forth in this Article
IX.
