As used in this Article, the following terms shall have the meanings hereinafter prescribed:
COMMITTEE
The Committee of Public Safety or any committee appointed by the Mayor with jurisdiction over the Department.
COUNCIL
The Mayor and Council of this borough.
DEPARTMENT
The Police Department of this borough.

A Police Department shall be and the same is hereby established in the Borough of Neptune City and may consist of one Chief of Police and/or Director of Public Safety, one or more Police Captain(s), one or more Police Lieutenant(s), one or more Police Sergeant(s), one or more Police Detective(s), one or more Police Corporal(s), one or more regular police officer(s), and one or more Police Dispatcher(s), as the Mayor may, from time to time designate, subject to confirmation of the Council.

None of the offices, unless already filled, need be filled until such time as the Mayor and Council shall deem it advisable.
First grade policemen shall consist of present uniformed policemen in the Borough of Neptune City and such other men as the Committee recommends, the Mayor appoints and the council confirms.

Special law enforcement officers may be appointed, as the Borough Police Committee recommends, the Mayor appoints and the Borough Council confirms, for extra police work, all in accordance with the provisions of the Special Law Enforcement Officers' Act (N.J.S.A. 40A: 14-146.8 et seq.). All special law enforcement officers, including Class I Officers, shall have the power to issue summonses for disorderly persons and petty disorderly persons offenses, violations of municipal ordinances and violations of Title 39 of the revised statutes, all as contemplated in the Special Law Enforcement Officers' Act and as set forth in N.J.S.A. 40A:14-146.11. Other special law enforcement officers may be appointed from time to time in accordance with the provisions of this Chapter 24, at the request of private parties, subject to approval by the Police Committee. No special law enforcement officer shall be appointed for more than a term of one year.

Promotions shall be made from the members of the Department after such mental, physical, oral and written examinations as may be prescribed by the Police Committee and approved by the Mayor and Council, subject to law.

The Council shall establish, and may from time to time, amend and repeal such rules and regulations as it deems necessary for the governing and efficient working of the Department. The rules and regulations shall be transmitted to the Chief of Police and/or Director of Public Safety by the Administration of Justice Committee. Within five days after the adoption of such rules and regulations or any amendment or repeal thereof, a copy thereof shall be posted or made available by the Chief of Police in the room of the Municipal Building assigned to the Police Department and a copy filed with the Borough Administrator.
All members of the Police Department shall be subject to the rules and regulations presently in existence and also shall be subject to additional rules and regulations that may be adopted by the Council. Subject rules and regulations may provide for penalties and forfeitures as the Council may deem necessary and expedient.

No person shall be appointed to membership in the Department who does not meet the qualifications prescribed by law.

The Mayor shall be designated the "appropriate authority" as provided for in N.J.S.A. 40A:14-118 or any successor statute. The Mayor shall be responsible for the overall performance of the Police Department. The Mayor shall, from time to time, adopt and promulgate rules and regulations which shall be subject to confirmation by resolution of the governing body of the Borough, for the governing of the Police Department, for the discipline of its members and any other lawful matters concerning said Police Department. All members of the Police Department shall be subject to such rules and regulations. The Chief of Police or the Director of Public Safety (if there exists one) shall be in charge of and shall have supervision and control of the Police Department, consistent with and subject to the provisions of N.J.S.A. 40A:14-118.
