This chapter shall be known and may be cited as the "Site Plan Review Ordinance of the Borough of Neptune City" and is adopted pursuant to the provisions of Section 28 of P.L. 1975, c. 291 (N.J.S.A. 40:55D-37).

A. 
The definitions as set forth in the Municipal Land Use Law, Chapter 291, Laws of New Jersey 1975 (N.J.S.A. 40:55D-1 et seq.), are incorporated herein by reference.
B. 
Whenever a term is used in this chapter which is defined in N.J.S.A. 40:55D-1 et seq., such term is intended to have the meaning set forth in the definition of such term found in such statute unless the contrary intention is clearly expressed from the context of this chapter or by definition in this chapter.
C. 
For purposes of this chapter and as provided for by the Municipal Land Use Law, Chapter 291, Laws of New Jersey 1975 (N.J.S.A. 40:55D-3), the term "administrative officer" shall mean the Borough Engineer as appointed by the Mayor and Borough Council. Except as modified by this chapter or elsewhere in the Code of the Borough of Neptune City, the administrative officer shall have all of the responsibilities and duties set forth in the Municipal Land Use Law, Chapter 291, Laws of New Jersey 1975 (N.J.S.A. 40:55D-1 et seq.).

A. 
Full site plan approval shall not be required for any residential detached single-family dwelling building or any permitted accessory use incidental to such residential use.
B. 
No building permit, certificate of occupancy and/or certificate of compliance shall be issued for any building or use or change in use of any building or enlargement in size of any building or use, or alteration by way of construction with respect to any building or use, including accessory structures, unless an applicable site plan pursuant to this chapter is first submitted to and approved by the approving authority or board. No certificate of occupancy and/or certificate of compliance shall be issued by the applicable authority in the Borough of Neptune City unless all construction, development and site improvements conform to the plans as approved by said reviewing board and the Building Official and/or enforcement official and/or Construction Code Officer.
C. 
Site plan review and approval or site plan exemption shall be required to construct, pave or expand off street parking in all zones, except for a driveway of single-family residences.

D. 
Site plan review and approval or site plan exemption shall be required before any excavation, site clearing or modifying the natural condition of any land, except for a maximum of 200 feet, provided that no adverse impact to any neighboring property is created.
