No operator of a vehicle shall stop, stand or park the vehicle in any space on public or private property appropriately marked in accordance with N.J.S.A. 39:4-198 for the physically handicapped unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or a passenger in that vehicle. No person shall move a vehicle not lawfully under his control into any such handicapped parking space.
A. 
The designation of handicapped parking spaces are approved by resolution by the Mayor and Council and are amended from time to time as needed.
B. 
The resolution is adopted by lot and block number.
C. 
The current designation of handicapped parking spaces are on file with the Municipal Court, the Police Department and the Borough Clerk.

Pursuant to Public Laws 1989, Chapter 20, every person convicted of a violation of this Article shall be liable to a penalty of a fine of $100 for a first offense, and for subsequent offenses, the penalty shall be a fine of at least $100 and up to 90 days community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.
