The purpose of this article is to preserve the public peace and to contribute to the public welfare, safety and good order of its people and to contribute to the safe conveyance of its people over the streets and sidewalks by establishing certain regulations for the maintenance of and snow removal on the sidewalks of the Village.
A. 
Duty to repair sidewalks. The Village of Bloomfield Department of Public Works shall be responsible for all necessary preventive and corrective maintenance of Village sidewalks which results from normal wear. Repairs for damage to sidewalks resulting from utility companies' or contractors' work will be the responsibility of the utility or contractor and will be made to the specifications as stated in § 115-9 of this chapter.
B. 
Conditions that may constitute a defective sidewalk. A "defective sidewalk" that is not in accordance with the standards set forth in § 115-6 shall mean any sidewalk which has any or all of the following conditions:
(1) 
Unacceptable quality of sidewalk surfacing, including but not limited to holes, depressions, breaks, or projections.
(2) 
Ridges or gaps between adjoining sidewalk blocks.
(3) 
Differences in elevation of the surface or of adjoining sidewalk blocks.
(4) 
Peeling or crumbling of the surface of the sidewalk.
(5) 
Tilting of sidewalk or sidewalk blocks except in the case of handicap ramps, driveway approaches or other similar situations.
(6) 
Missing portions of surface.
C. 
Maintenance of grass in sidewalk area: which is defined as all area as lies between the face of the curb, or if there is no curb, then that line where the paved roadway ends and where the curb would lie if the same existed, and the property line of the adjacent real property and shall include the curb, sidewalk, whether paved or otherwise, apron and any grass strip, trees, shrubbery or other vegetation and any other real property so located, whether improved or unimproved.

(1) 
No grass portions of the sidewalk area in any residential district shall be covered by brick, blacktop, stone or any other materials.
(2) 
The owner/and or occupant of any adjacent real property shall keep the adjacent sidewalk area free from litter, weeds, rubbish, garbage and obstructions of every kind.
(3) 
The owner and/or occupant of any adjacent real property shall cut the grass within the sidewalk area to a maximum height of four inches.
D. 
Litter and vegetative waste.

(1) 
Litter. No person shall drop, throw, scatter or deposit litter in or upon any street, sidewalk, alley, parking lot or other public place within the Village. Persons owning or occupying places of business within the Village shall keep the sidewalk free of litter and will deposit such litter in public receptacles or authorized private receptacles.
(2) 
Vegetative waste. No resident, or his/her agent, shall shovel, sweep, blow, rake or cause to be placed grass, leaves, brush, straw, tree stumps, dirt, sand, debris or any other substance tending to cause an obstruction on any public sidewalk area or street or on or near any catch basins.
Upon receipt of written information that a sidewalk may be defective, the Superintendent of Public Works, or his agent, shall make an inspection of the sidewalk and make a report of same and shall take any or all corrective actions with respect thereto as soon as is practical.

All replacement sidewalks shall be made of concrete and be consistent with the dimensions and mixture specifications of the existing or adjacent sidewalk blocks.
B. 
No contractor or utility company may begin repairs to a sidewalk until it has filed a certificate showing that it carries workers' compensation for all of its employees.

Snow removal will be done by the Village Department of Public Works (DPW) or its designee. Snowplowing will be done by the Village DPW as directed by the Superintendent of Public Works or as time permits.
B. 
The owners or occupants of buildings adjacent to sidewalks shall take measures to protect the public from falling snow, ice or water from said buildings. The property owner or occupant will be liable for any injury or accident which results from such falling snow, ice or water.
C. 
The Village DPW will not be responsible for salting sidewalks.
The use of snowmobiles or other motorized vehicles is expressly prohibited on Village sidewalks.
A. 
It shall be unlawful for any person, whether interested or not in the property, affected by this article to hinder or obstruct the DPW or any person acting on their behalf, such as a contractor, in the performance of work on the sidewalks.
B. 
Notice of violation. In the event of any violation of this article, the Code Enforcement Officer shall serve the owner and occupant with written notice of any violation. Such notice shall be sent by certified mail.

C. 
Any person(s) violating any provisions of this article shall be subject to a penalty not to exceed $250 or imprisonment for not more than 15 days, or both such fine and imprisonment.
