The Borough Council is hereby authorized to establish, from time to time, the charges and fees for sewer and incidental services to be provided by the Sewer Utility. Effective January 1, 2009, the Borough Council hereby adopts the schedule of charges currently established by the Florham Park Sewerage Authority[1] for the collection, disposal and treatment of sanitary sewage material charged to all customers of the Authority.[2]

A. 
Any party seeking to obtain any permits or other form of approval from the Sewer Utility which requires plan review and/or site inspection by the Sewer Utility's professional engineer shall establish an escrow account with the Borough for the purpose of covering professional costs associated with the review of any such application. The escrow amount shall be as set forth herein.
B. 
The Sewer Utility shall establish an escrow account as described herein, which shall be established, administered, managed, replenished and closed out in the same fashion as the escrow accounts for site plan and subdivision purposes as set forth in §§ 212-9 and 212-23 of this Code.
C. 
This section is not intended to replace the requirement for escrows for professional reviews of site plan and subdivision review by the Sewer Utility's professionals or staff. This section is intended to establish an escrow requirement and process for sewer plan reviews and inspections that are not otherwise subject to site plan and subdivision review, including but not limited to submissions to the Sewer Utility prior to filing for site plan or subdivision approval, or submissions to the Sewer Utility after close out of an escrow established in connection with a site plan or subdivision application.
D. 
Escrow deposits shall be paid when the sanitary sewer application is filed.
E. 
The following amount shall be the initial deposit required for sewer plan review and/or inspection:
(1) 
Commercial property: $500.
(2) 
Multifamily residential property: $2,000.
(3) 
Subdivisions: $500.
