Marcus Hook Borough Council finds and declares that the provisions
of this chapter are enacted to establish regulations regarding the
operation of skateboards, scooters and rollerblades on the highways,
streets, roadways, sidewalks, public parks, school yards, paths or
other public places within the Borough of Marcus Hook, Delaware County,
Pennsylvania.
Unless otherwise indicated, all provisions of this chapter shall
apply to all skateboards, scooters and rollerblades, as herein defined,
operated or controlled within the jurisdictional boundaries of the
Borough of Marcus Hook.
As used in this chapter, the following terms shall have the
following meanings:
The portion of the highway or road designed or ordinarily
used for vehicular travel, excluding sidewalks.
Shoes or boots affixed to two plastic or other synthetic
material wheels used to glide or skate over surfaces.
A single platform mounted upon two plastic or other synthetic
material wheels which is propelled solely by human power and which
has a single bar steering device with which to control the movement
or direction of the scooter.
That portion of the highway designated or ordinarily used
for pedestrian travel.
A single platform mounted on metal, rubber, plastic or other
synthetic material wheels, which is propelled solely by human power
and which has no handheld mechanisms or other device with which to
steer or to control the movement or direction of the platform.
Traffic generated by every device, excluding skateboards,
scooters, rollerblades, wagons, wheelchairs, unicycles, pushcarts,
tricycles, and other children's toys, by which any person or
property is or may be transported or drawn upon a highway, street,
roadway or sidewalk.
A.
No person shall ride or use a skateboard, scooter or rollerblades
upon any highway, street, roadway, sidewalk, public park, school yard,
path or any other public place in a manner that would obstruct pedestrian
traffic or endanger another person's safety, or ride or use a
skateboard, scooter or rollerblades on any highway, street, or roadway
in a manner that would impede the normal flow of vehicular traffic.
B.
No person shall permit a skateboard, scooter or rollerblades to stand
upon any highway, street, roadway, sidewalk, public park, school yard,
path, or any other public place where it is an obstruction or hazard
to pedestrians.
C.
No person shall ride a skateboard, scooter or rollerblades, onto,
on top of or off of any bench, chair, flower box, retaining wall,
stairway, ramp, curb, handrail, or other public accessory or structure
not intended for pedestrian foot traffic, or intended only for pedestrian
foot traffic. Additionally, no person is permitted to apply wax or
other product used for the purpose of grinding a skateboard on any
public or private property.
D.
The Borough of Marcus Hook Police Department is authorized to erect
official traffic control devices on those highways, streets, roadways
or other public places or property where skateboarding, rollerblading
or riding of scooters shall be designated as prohibited.
E.
No person shall operate, ride or use a skateboard, scooter or rollerblades
on any highway, street or roadway where the volume or speed of the
vehicular traffic or the width of the roadway renders the highway,
street or roadway unsafe or unsuitable for skateboarding, rollerblading
or the riding of scooters.
F.
Skateboard, scooter or rollerblade operators on sidewalks, highways,
streets or roadways shall yield the right-of-way to all vehicular
and to all other pedestrian (non-skateboard, -scooter or -rollerblade)
traffic upon the sidewalk, highway, street or roadway.
G.
No more than one person shall operate or ride on a single skateboard
or scooter.
H.
No person shall place a ramp, half-pipe or other structure used for
skateboarding in a public thoroughfare, street, upon a sidewalk or
municipal parking lot.
I.
Anyone under the age of 12 must wear a helmet while riding a skateboard,
scooter or using rollerblades.
The Chief of Police or his/her designee is authorized to establish
all written regulations necessary to implement this chapter's
provisions, including regulations on posting of signs on private or
public property where the riding of skateboards, scooters or use of
rollerblades shall be prohibited.
No person shall operate a skateboard or scooter or use rollerblades
on any highway, street, roadway or public alley in the Borough of
Marcus Hook in violation of any traffic ordinance of the Borough of
Marcus Hook or the law of the Commonwealth of Pennsylvania.
Every person convicted of violation of any provision of this
chapter shall be punished by a fine of not more than $50 and shall
be ordered to pay restitution should any damage or injury have resulted
from the act giving rise to the violation of this chapter.
