A. Purpose. The purpose of this section is to define and establish the
applicable standards and restrictions with the raising, keeping and
maintaining of miniature pigs as domestic pets within the Borough
of Lincoln Park.
B. Definitions. As used in this section, the following terms shall have
the meanings indicated:
MINIATURE PIG
A domesticated pet pig that includes a variety of breeds,
including pot-bellied pigs, that has been bred to be a domestic pet.
For purposes of this section, the full mature weight of a miniature
pig shall not exceed 120 pounds.
C. Application for license. No person shall keep, harbor or maintain a miniature pig without first obtaining a license therefor, such license to be issued by the Health Department of the Borough upon application by the owner, or by some person on behalf of the owner and payment of the prescribed fee. This application shall be made and renewed in the month of January every year. The application shall set forth the name and address of the applicant and the location of the property for which the license is sought. An annual fee shall be as set forth in Chapter
34, Fees, §
34-2.
D. Immunization. At the time of acquiring the license and registration
tag, the applicant shall present proof that the miniature pig has
been immunized in accordance with veterinary standards for the State
of New Jersey to cover the period of licensing. In addition, the miniature
pig shall be spayed or neutered, and a certification from a licensed
veterinarian must be submitted with the application for the license.
E. Maximum number. In no case shall any person or person be permitted to keep in the Borough more than two miniature pigs on their property except as may be permitted by a commercial farm in conformance with all requirements of Article
XXV of Chapter
28, Zoning, of this Code.
F. Running at large. No person owning, keeping or harboring a miniature
pig shall suffer or permit such miniature pig to run at large within
the Borough. It shall be deemed a violation of this section if a miniature
pig is found off the premises of the owner and not under the control
of the owner, a member of the owner's household or a representative
of the owner by leash, cord, chain, either, or other suitable device
not more than six feet long.
G. Defecation on public/private property prohibited. No person owning,
keeping or harboring a miniature pig shall suffer or permit such miniature
pig to soil, defile, defecate upon or commit any nuisance in or upon
any public street, pathway, sidewalk, public property or any place
open to the public or the private property of another. It shall be
a defense if the person immediately removes all feces or other bodily
waste deposited by such miniature pig in a sealed, nonabsorbent, leakproof
container and disposes it in an appropriate sold waste container.
H. Defecation on owner's property. No person owning, keeping, harboring
or exercising control over any pig shall permit or suffer the accumulation
of miniature pig feces or other bodily waste upon any property owned,
occupied or controlled by such person, to the extent that any odor
emanating from said feces or bodily waste may be noticeable to any
person on an adjoining property or public street.
I. Noise by pigs. No person shall keep any miniature pig causing a nuisance
and disturbing the peace and quiet of the neighborhood in which it
shall be kept by making such noise as to create such a disturbance.
J. Complaints/enforcement. It shall be the duty of the Animal Control
Officer, Health Officer or the Police Department to enforce the provisions
of this section.
K. Violations and penalties. Any person violating any provision of this section shall be subject to the penalties as prescribed by §
1-2 of this Code (General penalty).
