A. 
The provisions of this article apply to mobile food vehicles engaged in the business of cooking, preparing, and distributing food or beverage with or without charge upon or in public and private restricted spaces, as outlined herein.
B. 
This article does not apply to ice cream trucks, outdoor seating areas accessory to restaurants, or catering for guests of a private residential event.
As used in the article, the following terms shall have the meanings indicated:
MOBILE FOOD VEHICLE
A motorized or nonmotorized vehicle or cart, which may, upon issuance of a license by the Township Clerk and in conformance with the regulations established by this article, temporarily park upon public or private property and engage in the service, sale, or distribution of ready to eat food for individual portion service to the general public directly.
MOBILE FOOD VENDING
Vending, serving, or offering for sale food and/or beverages from a mobile food vehicle meeting the definition of a food service establishment under Public Act 92 of 2000, which may include the ancillary sales of branded items consistent with the food, including, but not limited to, a T-shirt that bears the name of the organization engaged in mobile food vending.
OPERATE
All activities associated with the conduct of business, including setup and takedown and/or actual hours where the mobile food vehicle is open for business.
PERMITTING PERIOD
An individual calendar month (e.g., the month of June).
TOWNSHIP SPONSORED SPECIAL EVENT
A special event sponsored, established, and run by the Township of Grosse Ile, or an affiliate thereof. Examples include, but are not limited to, Island Fest, DDA events, and community recreation events.
VENDOR
Any individual or a group of individuals engaged in the business of mobile food vending.
A. 
No vendor shall engage in mobile food vending within the Township of Grosse Ile without a permit from the Grosse Ile Township Clerk. A permit issued under this article is valid for one mobile food vehicle and shall not be transferable from vehicle to vehicle, or vendor to vendor.
B. 
The Township Clerk may issue up to three mobile food vehicle permits for any permitting period for operation within the Airport Commerce Park property. There shall be no limit of mobile food vehicle permits for Township sponsored special events.
C. 
Permits shall be issued on a first-come/first-served basis, provided applications shall be complete including all of the information required by § 185-27 below.
D. 
Permit applications will be accepted beginning the first day of the month preceding the permitting period requested.
E. 
Any permit issued under this article may be rescinded by Grosse Ile Township upon violation of any provision of this article, in addition to the right of Grosse Ile Township to prosecute violations of this article.
F. 
Past violations of this article, regardless of prosecution, may be used as cause for denial of future permit applications.
A. 
The permit application shall include the following:
(1) 
Name, signature, phone number, email contact and business address of the applicant.
(2) 
Written permission from the individual designated by the event sponsor, or Airport Commerce Park Manager, as applicable.
(3) 
A description of the preparation methods and food product offered for sale including the intended menu.
(4) 
Information on the mobile food vehicle to include year, make and model of the vehicle and dimensions, which shall not exceed 30 feet in length and 10 feet in width.
(5) 
Information setting forth the proposed hours and area of operation, plans for power access, water supply and wastewater disposal.
(6) 
Copies of all necessary license or permits issued by the Wayne County Health Department.
(7) 
Insurance coverage.
(a) 
Proof of general comprehensive liability policy with limits of no less than $2,000,000 combined single limit coverage issued by an insurer licensed to do business in the State of Michigan and which names the Township as an additional insured.
(b) 
Proof of public liability and property damage motor vehicle policy with limits of no less than $1,000,000 issued by an insurer licensed to do business in the State of Michigan.
(8) 
The required fee, as established by the Township Board.
All vendors receiving a permit under this article shall pay the fee as set forth by the Township Board.
A. 
Mobile food vending shall be permitted subject to the following requirements:
(1) 
Mobile food vending may only operate:
(a) 
During a Township sponsored special event, as authorized by the individual designated by the event sponsor;
(b) 
During a Township sponsored special event within the DDA District, as authorized by the DDA Director;
(c) 
Within the Airport Commerce Park, as authorized by the Airport Commerce Park Manager.
(2) 
Mobile food vending shall not be permitted within public rights-of-way. A minimum pedestrian clear space of five feet is required along all public walkways.
(3) 
Flashing, blinking, or strobe lights are prohibited. Exterior lights shall be hooded to direct illumination downward. Loud music, amplification devices or other audible methods to gain attention for the mobile food vending unit are prohibited.
(4) 
Hours of operation shall be as established by the applicable event sponsor, DDA Director or the Airport Commerce Park Manager.
(5) 
One portable sign no more than six square feet and not higher than four feet may be placed within five feet of the unit during operation. The sign shall not be in the public right-of-way, including on a sidewalk, and shall not impede pedestrian or vehicle circulation or safety.
(6) 
Cooking outside of the mobile food vehicle shall not be permitted within 200 feet of any residential zoning district or use.
(7) 
Appropriate trash receptacles shall be provided and all litter, debris, and waste attributable to the operation shall be removed at least on a daily basis.
(8) 
Vendors shall prominently display their permit on the mobile food vehicle.
Penalties for violation of this article shall be punishable as provided in Chapter 1, General Provisions.
