Chickens and roosters may be kept and maintained on residential
property within the Township of Montague only in accordance with the
provisions of this article. The following general requirements shall
apply:
A. The keeping and maintenance of chickens and other egg-laying poultry
on residential property that is farmland assessed pursuant to the
provisions of N.J.S.A. 54:4-23.1, the Farmland Assessment Act of 1964,
is not subject to the provisions of this article.
B. As used in this article, the term "residential property" shall mean property that is zoned and used for residential purposes pursuant to Chapter
76 of the Code of the Township of Montague, except for property designated "R-4 (R4) High Density Residential District," as provided for by §§
76-52 through
76-61 of the Township Code.
C. As used in this article, the term "nuisance" does not include a neighbor's
mere dislike of chickens or roosters.
The number of chickens and roosters permitted on a residential
property shall be limited by the size of the residential lot, and
as indicated in the following table:

Current owners of chickens and roosters are exempted from §
76-114, but shall be limited to possessing on their property quantities of chickens and roosters that are no greater than the quantities presently possessed by these current owners, except that, if the quantities of chickens and roosters that these current owners would be permitted to keep under §
76-114 are greater than the quantities presently possessed by these current owners, then these current owners shall be permitted to keep quantities of chickens and roosters in accordance with §
76-114.
