As used in this chapter, the following terms shall have the meanings indicated:
FARMERS MARKET
A food establishment having persons selling farm-raised products, including produce, meats, eggs, plants and flowers, selling derivative farm products, including dairy, produce and personal care products, and prepared food products, including baked goods, convenience goods and pet products, originating from state-inspected and -licensed facilities.
HUNTERDON LAND TRUST FARMERS MARKET
Shall be located at the Dvoor Farm, 111 Mine Street, Flemington, New Jersey, operating on Sundays. The facility shall be under the management of the Hunterdon Land Trust that is legally responsible for supervising market operation, annual licenses and compliance with orders of the Hunterdon County Department of Health and the Raritan Township Board of Health.
Hunterdon Land Trust must designate a Market Manager who is present on site whenever said market is in operation. Hunterdon Land Trust shall provide a list of all vendors operating under Chapter 24, Food Establishment Code, N.J.A.C. 8:24, at the Farmers Market and obtain an annual food license from the Raritan Township Board of Health.
Hunterdon Land Trust is responsible for any vendor's health violation(s) and will have subsequent penalties imposed upon it as it is the entity that obtained the license to allow the vendors to operate at the Farmers Market.
Hunterdon Land Trust will prohibit any vendor from selling at the Farmers Market if that request is made by the Hunterdon County Department of Health or the Raritan Township Board of Health.
The Hunterdon Land Trust Farmers Market at the Dvoor Farm is to have no food prepared on site under the farmers market license obtained by Hunterdon Land Trust, except as follows:
A. 
Hunterdon Land Trust may have persons demonstrate the cooking and preparation of produce and animal products and derivatives from produce and animal products, provided that the demonstrator shall obtain a separate temporary food license from the Raritan Township Board of Health and shall pay a separate fee for said license.
B. 
Hunterdon Land Trust may have food prepared by licensed food truck(s) operating under Chapter 258, Food Carts, Food Trucks and Other Commercial Vehicle-Based Activities, and as permitted by Chapter 249, Fires and Fire Prevention. Pursuant to Chapter 258 of the Revised General Ordinances of the Township of Raritan, Hunterdon Land Trust shall annually request authorization to have food truck(s) operating at the Farmers Market and include the dates and times of operation. Hunterdon Land Trust shall apply to the Raritan Township Board of Health for the required temporary food license for permitted food truck(s). No more than two food trucks are permitted.
The Hunterdon Land Trust Farmers Market shall have the majority of its approved vendors selling farm-raised products and shall have more approved vendors selling derivative farm products than approved vendors selling prepared food products.
The annual license fee for the farmers market established hereunder shall be equal to the sum that the Raritan Township Board of Health must pay to the Hunterdon County Department of Health for the inspections for the farmers market established hereunder operating under Chapter 24, Food Establishment Code, N.J.A.C. 8:24.
Hunterdon Land Trust shall be responsible for compliance with all other applicable state, county and local laws and ordinances. Specifically, if applicable, Hunterdon Land Trust shall comply with Chapter 347 of the Township Code, regulating "Peddlers, Solicitors, Canvassers and Transient Merchants."
