No parcel, lot, building, or structure in any district shall
be used or occupied in any manner so as to create any dangerous, injurious,
noxious, or otherwise objectionable element or condition so as to
adversely affect the surrounding area or adjoining premises, provided
that any use permitted by this Chapter may be undertaken and maintained
if acceptable measures and safeguards are employed to limit dangerous
and objectionable elements to acceptable limits as established by
the following performance requirements.

Any activity involving the use or storage of flammable or explosive
materials shall be protected by adequate fire-fighting and fire suppression
equipment and by such safety devices as are normally used in the handling
of any such material. Such hazards shall be kept removed from adjacent
activities to a distance which is compatible with the potential danger
involved.

A. The use of metal siding, including, but not limited to, aluminum
and steel, in the construction of the exterior of any building or
structure in the City of O'Fallon, Missouri, is hereby prohibited
except as set forth as follows:
1.
In areas zoned "I-2," no more than seventy-five percent (75%)
of the surface area of the front elevation (the elevation facing a
public street or road) may consist of metal siding. The remaining
area must be of an alternate material, including, but not limited
to, brick, split faced block, exterior finish insulation system (EFIS),
stucco, stone as approved by the Planning and Zoning Commission. All
other elevations may, but are not required to be, of entirely metal
siding. Notwithstanding the foregoing, in all areas zoned "I-2":
a.
Located along Interstate 70; or
b.
Adjacent to any area zoned "R-1," "R-1A," "R-2," "R-3" or "R-4,"
no more than twenty-five percent (25%) of the surface area of the
front elevation (the elevation facing a public or private street or
road) may consist of metal siding. The remaining area must be of an
alternate material, including, but not limited to, brick, split faced
block, exterior finish insulation system (EFIS), stucco, stone as
approved by the Planning and Zoning Commission. Metal siding may have
exposed fasteners.
2.
In areas zoned "I-1," no more than twenty-five percent (25%) of the surface area of the front elevation (the elevation facing a public street or road) may consist of metal siding. The remaining area must be of an alternate material, including, but not limited to, brick, split faced block, exterior finish insulation system (EFIS), stucco, stone as approved by the Planning and Zoning Commission. Metal siding used in areas zoned "I-1" may not have exposed fasteners. Notwithstanding the foregoing, in platted industrial parks in existence as of October 24, 2002, metal siding may be used consistent with the construction of existing buildings or structures in the industrial park, provided that the requirements of Subsection
(A)(1) hereof shall be the minimum requirements.
3.
In areas zoned "C-O," "C-1," "C-2," "C-3," "HTCD" or "MUTDD,"
metal siding may not be used in the construction of the exterior of
any building or structure. Notwithstanding the foregoing, trim and
acceptable materials may include metal, provided that not more than
fifteen percent (15%) of the surface area of any elevation is constructed
of such material.
4.
In areas zoned "R-1," "R-1A," "R-2," "R-3," "R-4," "R-5," or
"P-R," metal siding may not be used in the construction of the exterior
of any building or structure.
5.
In areas zoned "AG," metal siding may be used in the construction
of the exterior of any building or structure.
B. As used herein, the term "metal siding" does not include standing
seam metal roofs, metal windows, metal soffit or facia or metal gutters
and downspouts.
C. The provisions of this Section shall not apply to the following:
1.
Any building or structure for which site plan approval has been
granted or for which a building permit has been issued as of the date
of passage of this Section;
2.
Any building or structure otherwise exempt from these requirements
pursuant to existing law; or
3.
Any accessory structures to a single- or two-family residence.

No activity shall emit dangerous radioactivity at any point,
or unreasonable electrical or radio-electrical disturbance adversely
affecting the operation at any point of any equipment other than that
of the creator of such disturbance.

No vibration shall be permitted which is discernible without
instruments on any adjoining lot or property.

Smoke shall not be emitted with a density greater than on the
Ringelmann Chart as issued by the U.S. Bureau of Mines except for
blow-off periods of ten (10) minutes duration of one (1) per hour
when a density of not more than No. 2 is permitted.

No malodorous gas or matter shall be permitted which is offensive
so as to produce a public nuisance or hazard on any adjoining lot
or property.

No pollution of air by fly-ash, dust, vapors, or other substances
shall be permitted which is harmful to health, animals, vegetation,
or other property, or which causes soiling of exposed property.

No direct or reflected glare shall be permitted which is visible
from any property or from any public street, road, or highway.

Noise which is objectionable due to volume, frequency, or beat
shall be muffled or otherwise controlled so that there is no production
of sound discernible at lot lines in excess of the average intensity
of street and traffic noise at the lot lines. Air raid sirens and
related apparatus used solely for public purposes are exempt from
this requirement. The L-10 noise level [that level which is exceeded
ten percent (10%) of the time] shall not exceed the following measurements
at any point past the property line of the lot on which the noise
is generated:

Pollution of streams and other bodies of water shall be subject
to such requirements and regulations established by the State of Missouri,
Department of Natural Resources (Water Quality Standard - 10 CSR 20
- 7.031) and the City of O'Fallon.

It shall be the responsibility of the Planning and Zoning Commission
to review the site plans for a development to assure all performance
standards will be addressed. If questions should arise about the compliance
with the standard, they will be forwarded to the City Council for
its review.
