Commencing on the effective date of this article, it shall be unlawful for any person, corporation or organization, including municipal authorities, to place upon the public streets of the City of Kingston, for whatever purpose, a device generally described as an ignited smudge pot or flame-operated torch or lantern, other than battery-operated danger signals or lights. Nothing herein contained shall prevent the use of flares or emergency equipment at accident scenes.
Any violation of the terms hereof shall constitute a Class B misdemeanor and shall be punishable as such in accordance with the Penal Law of the State of New York.
This article shall take effect on August 1, 1973, following final passage, public hearing and approval by the Mayor of the City of Kingston, New York, as provided by law.
