A. Pursuant to the provisions of Sections 201 through
211, inclusive, of the Pennsylvania Municipalities Planning Code (the
Act of July 31, 1968, No. 247, as amended), there is hereby created and established a Planning Commission
for the Borough of Mount Pocono which shall consist of five members,
all of whom shall be residents of the Borough.

B. Except for elected or appointed officers or employees
of the Borough, members of the Commission may receive compensation
in an amount fixed by the governing body. Compensation shall not exceed
the rate of compensation authorized to be paid to members of the governing
body. Without exception, members of the Planning Commission may be
reimbursed for necessary and reasonable expenses. However, elected
or appointed officers or employees of the Borough shall not, by reason
of membership thereon, forfeit the right to exercise the powers, perform
the duties or receive the compensations of the municipal offices held
by them during such membership.
The members of the Planning Commission shall
be appointed by the Borough Council for terms of four years or until
a successor is appointed and qualified; provided, however, that pursuant
to the provisions of Section 203 of the Pennsylvania Municipalities
Planning Code the terms of the members initially appointed shall be
as follows:
A. One member for four years;
B. Two members for three years;
C. Two members for two years;
D. Two members for one year each.

The Planning Commission shall have all of the
powers and duties conferred and imposed upon a Planning Commission
by Section 209.1 of the Pennsylvania Municipalities Planning Code and any amendments or supplements thereto.
The Planning Commission shall elect its own
officers who shall serve for annual terms and may succeed themselves.
The Commission may make and alter by laws and rules and regulations
to govern its procedures consistent with the ordinances of the Borough
of Mount Pocono and the laws of the Commonwealth of Pennsylvania.
The Commission shall keep a record of its business and shall annually
make a written report by March l of each year of its activities to
the Borough Council.
