This chapter is enacted in the interest of public
safety and public health and for the prevention of fires and fire
hazards in the Borough of Conway. In addition, this chapter is enacted
to eliminate nuisances caused by smoke and cinders to persons living
within the Borough of Conway and for the purpose of preventing damage
to the surface of the streets, sidewalks and alleys within said Borough.
As used in this chapter, the following terms
shall have the meanings indicated:
Any individual, partnership, limited partnership, association
or corporation.

No person or persons shall set or maintain any
fire upon any of the streets, sidewalks, alleys or public properties
in the Borough of Conway, or burn or cause to be burned any paper,
boxes, rubbish, refuse, leaves, brush, litter or any combustible or
flammable waste of any kind; nor shall any person or persons set or
maintain any fire or burn or cause to be burned any substance or material
of any kind out of doors on private or public property within the
limits of the Borough of Conway except in accordance with the rules
and regulations of this chapter.

Out-of-door fires shall be permitted only upon
private property within the Borough of Conway, provided that every
such out-of-door fire shall be built in and confined to a noncombustible
container and shall be attended by an adult or minor of the age of
16 years or older until such fire has been safely and completely extinguished.
No fire shall be set, maintained or allowed to burn closer than 15
feet to any building, and no fire shall be permitted except on Tuesday
and Wednesday of each week only between the hours of 6:00 a.m. and
6:00 p.m. If a Tuesday or Wednesday shall fall upon a legal holiday,
burning will not be permitted. Materials which may be burned are limited
to the following: paper, cardboard or wood. Charcoal fires for the
purpose of cooking shall be permitted on all days and at all times
within the limits of the Borough of Conway.
In the event any person or persons desire to
burn off a lot or tract of land or desire to burn a pile of rubbish,
brush, litter, etc., too large to be confined in a noncombustible
container, such person or persons must first notify the Conway Volunteer
Fire Department of his or their intention and shall not burn off said
lot or burn said pile of rubbish without first securing the written
permission of the Fire Chief or Assistant Fire Chief of said Volunteer
Fire Department. If such permission is given, it shall include a designated
time for such burning and shall stipulate such other conditions as
may be deemed necessary by the Fire Chief or Assistant Fire Chief
for the safety and protection of the public.

Any person who shall violate or fail to conform
to any of the provisions of this chapter shall, upon conviction thereof,
be sentenced to pay a fine of not more than $300 and costs of prosecution
or to imprisonment in the county jail for not more than 30 days, or
both.
