WHEREAS, the town and the state have expended considerable sums for installation of bus shelters to serve the public welfare; and
WHEREAS, the maintenance of bus shelters free of defacement, posting of signs or commercial or other uses detrimental to the public welfare is in the public interest; and
WHEREAS, it is in the public interest for bus shelters to be uncluttered in space for maximum use by bus passengers; and
WHEREAS, it is detrimental to the public interest for bus shelters to be damaged, destroyed or defaced by anyone;
Now, therefore, be it ordained by the Board of Commissioners of the Town of West New York, County of Hudson, State of New Jersey, as follows:
No person, firm or entity shall draw, paint, publish or affix any words, scrawl, sign, advertisement or public or private notice, sign or message on any bus shelter or part thereof which is located within the Town of West New York.
No person, firm or entity shall knowingly authorize or permit his name, address or picture to be used, posted or stated by any other person, firm or entity on any scrawl, sign, advertisement or public or private notice, sign or message posted or installed on any bus shelter located within the Town of West New York. The payment or giving of consideration for same shall raise the presumption of knowing and intentional authorization or permission.
No person, firm or entity shall have the right to nor install any mechanical device, heater, vending machine, newspaper, candy, condiment, cookie, nut, fruit or other product-vending machine nor any bench or other device containing a sign, message or picture nor arrange any portion of the bus shelter contents in a manner to serve any purpose other than maximum use for bus passenger waiting comfort.
No person, firm or entity shall damage, destroy, deface or otherwise destruct any bus shelter or part thereof.
The provisions of this article shall not apply to any state or municipal signs, pictures or messages of a public interest, nonpolitical nature nor to any temporary sign, picture or message of a charitable, nonprofit organization, provided that such organization shall obtain the prior written permission of the Mayor and Board of Commissioners to post said temporary sign, picture or message for a period not to exceed 30 consecutive calendar days.

Any person who is convicted of a violation of any section of this article shall be subject to a fine not to exceed $1,000 and/or imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days.

A. 
Sections 170-8 through 170-13 of this article shall not apply to the placement of advertisements, signs, insignias, decals, or other distinctive or purposeful markings on a bus shelter constructed, installed or maintained by any party, pursuant to an agreement with the Town of West New York.
B. 
The placement of advertisements, signs, insignias, decals, or other distinctive or purposeful markings on a bus shelter constructed, installed or maintained by any party, pursuant to, in anticipation of, or in furtherance of an agreement with the Town of West New York, shall not be considered to be in violation of any ordinance of the Town of West New York.
C. 
This section shall be retroactively applied.
