Borough of Sea Bright, NJ Chapter 23 Funds

Article I Sewer Utility Fund

[Adopted 11-16-1993]

§ 23-1 Sewer utility established.

The municipal sewer system, consisting of main sewers, sewers, lateral sewers, sewer receptacles, pumping stations and any and all improvements, erections, works, establishments, sewer treatment or disposal plants and fixtures to provide proper sewerage and drainage for the Borough of Sea Bright and controlled and managed by the Borough, whether owned or controlled by it, is hereby created and established as a municipal public utility for all of the purposes of the Local Bond Law of New Jersey[1] and the Local Budget Law of New Jersey.[2] Said municipal public utility is hereby found and determined to be a utility, enterprise or purpose authorized to be undertaken by the Borough of Sea Bright and from which it may receive rates, rentals or other charges for or in connection with or the use of services of such municipal public utility which shall be held, used and applied in accordance with the provisions of the Local Bond Law and the Local Budget Law and any other applicable laws.

§ 23-2 Transfer of income, costs and expenses to sewer utility fund.

All income, costs, expenses and debt service obligations, including outstanding sewer general obligation debt and improvement authorizations, shall be and are hereby transferred to a sewer utility fund.

Article II Beach Utility Fund

[Adopted 5-3-1994]

§ 23-3 Beach utility established.

The Municipal Beach, consisting of the present Borough beach facilities and parking lot, the newly acquired Peninsula House property and the state-owned but Borough-operated Anchorage Beach Club property, is hereby created and established as a municipal public utility for all of the purposes of the Local Bond Law of New Jersey.[1] Said municipal public utility is hereby found and determined to be a utility, enterprise or purpose authorized to be undertaken by the Borough of Sea Bright and from which it may receive rates, rentals or other charges for or in connection with or the use of services of such municipal public utility which shall be held, used and applied in accordance with the provisions of the Local Bond Law and the Local Budget Law[2] and any other applicable laws.

§ 23-4 Transfer of income, costs and expenses to beach utility fund.

All income, costs, expenses and debt service obligations, including outstanding beach general obligation debt improvement authorizations, shall be and are hereby transferred to a beach utility fund.
