The following chapter with all ordinances supplementary thereto, or amendatory thereof, shall constitute and be known as the "Sanitary Code of the Borough of Sea Bright."
A. 
The following terms when used in this chapter shall be construed as follows:
BOROUGH
The Borough of Sea Bright.
CODE or SANITARY CODE
The provisions of this chapter and all ordinances supplementary thereto or amendatory thereof.
FOOD
Includes every article used for food or drink and every ingredient in such article and all confectionery and condiments.
FOOD ESTABLISHMENT
Any and all stores, premises, places or vehicles used for the selling, distribution, serving, delivery, production, preparation, manufacturing, packing, storage, transportation or handling of food or drink.
PERMIT or LICENSE
Construed to mean the written permission of the Borough.
PERSONS
Includes both singular and plural, as the case demands, and shall include any individuals, corporations, companies, societies, firms, partnerships, associations and joint stock companies. Wherever the word "person" is used in the code, it shall also be held to apply to all municipalities and all municipal corporations.
B. 
All words and phrases defined herein shall also include their natural and usual meanings as well as those herein especially given.[1]

No person shall conduct, operate or maintain any food establishment without obtaining a license therefor from the Monmouth County Regional Health Commission No. 1 for each and every such food establishment. The fee for every such license shall be set by the Monmouth County Regional Health Commission, and the license shall expire on the 30th day of June next succeeding the date of issue. Said license, when for premises, shall be displayed in a conspicuous manner plainly visible to patrons and, when for vehicles, shall be displayed in one side thereof, plainly visible to patrons.
A. 
It shall be the duty of the owner, tenant, lessee or occupant of any house, store, building, or of any part thereof, or of any premises in the Borough, to place in a watertight container, which shall have a proper cover for the opening thereof, all garbage, decaying vegetable and animal substance upon his or their premises, in which container shall be placed no other household refuse.

B. 
Every owner, tenant, lessee or occupant of any house, store, building, or of any part thereof, or of any premises in the Borough shall place every container containing garbage, trash or other refuse upon the sidewalk, in front of his premises, as near the curb as the same can be conveniently placed, only after 7:00 p.m. on the evening prior to the date scheduled for collection, and after the receptacles are emptied, remove them from the sidewalk before 7:00 p.m. on the day of collection. The scheduled dates may be obtained from the office of the Borough Clerk.
C. 
The owners of any property occupied by tenants, whether residential or commercial, shall be responsible in the event of a violation of any of the foregoing schedules.
D. 
In the event any trash, garbage or refuse is placed out for collection at any other time or earlier than 7:00 p.m. on the evening prior to a collection day, this shall constitute a violation of this chapter, and violators, if convicted in the Municipal Court of the Borough of Sea Bright, shall be subject to a fine not to exceed $750.
E. 
All receptacles used for the storage of garbage or decayed animal or vegetable substance shall be of a size which can be conveniently handled by the collector or remover of the same.

No animal or vegetable substance, no swill or garbage nor any offensive or putrescible material whatsoever shall be dumped, deposited on or used to fill in or to raise the surface or level of any ground, lot or street in the Borough, and no person shall permit such putrescible material to be dumped on any land in the Borough of which he is the owner, lessee or occupier.

The Borough may, from time to time, adopt such rules and regulations as shall, in its judgment, aid in the proper understanding and general enforcement of the Sanitary Code, all other ordinances and amendments thereof and supplements thereto.
Any person who shall violate any provisions of this code shall, upon conviction thereof, be subject to a fine of not less than $50 nor more than $1,000 for each violation. Each violation and each day a violation is committed or permitted to continue shall constitute a separate violation and shall be punishable as such.
