The word "City" as hereinafter used shall mean and designate the City of El Reno, Canadian County, State of Oklahoma, and the word "Company" as hereinafter used shall mean and designate Multimedia Cablevision, Inc., d/b/a Multimedia Cablevision of El Reno.
A. 
This nonexclusive franchise ordinance, when the same is approved by a majority vote of the qualified electors of the City voting in this election, does hereby grant for a period of 15 years from September 26, 1998, to the Company, the right and privilege to construct, erect, operate and maintain, in, upon, along, above, over and under the streets, alleys, easements, public ways and public places now laid out or dedicated, and all extensions thereof, and additions thereto, in the City, poles, wires, fiber, cables, and underground conduits, manholes, and other conductors and fixtures necessary for the maintenance and operation in the City of a broadband telecommunications network subject to the provisions of this ordinance.
B. 
The right to use and occupy said streets, alleys, public ways and places for the purposes hereinafter set forth shall not be exclusive, and the City reserves the right to grant on the same terms and conditions a similar use of said streets, alleys, public ways and places, to any person, company or other organization at any time during the term of this nonexclusive franchise.
All rights and privileges derived from this nonexclusive franchise ordinance, when the same is approved by a majority vote of the qualified electors of the City voting in said election, are expressly granted subject to and limited by the provisions of Ordinance No. 2847, as it presently exists or may hereafter be amended. The provisions of said ordinance, as it may be later amended, are specifically made a part of the franchise agreement and shall be complied with by the Company during the life of the nonexclusive franchise period. Copies of said ordinance shall be maintained for the benefit of the public in the office of the City Clerk from and after passage of this ordinance.
An election is hereby called for the purpose of submitting this ordinance to the qualified electors of the City for their approval or disapproval. The election shall be held on the 9th day of December, 1997, between the hours of 7:00 a.m. and 7:00 p.m. The Mayor is authorized and directed to issue an election proclamation calling such election and is directed to take all steps that may be necessary for holding the election and for the submission of this ordinance to the qualified electors of the City. If the qualified electors of the City fail to approve this nonexclusive franchise at said election, no rights shall accrue hereunder. At such election, the proposition to be voted upon shall be substantially as follows:
PROPOSITION
Shall Ordinance No. 2848 of the City of El Reno, Oklahoma, granting a franchise, be passed for a period of 15 years to Multimedia Cablevision, Inc., d/b/a/ Multimedia Cablevision of El Reno, which includes the right to operate for the term of aforementioned franchise a Broadband Telecommunications Network using state of the art equipment that will be capable of providing 110 channels of programming.

Whereas it being immediately necessary for the preservation of the peace, health and safety of the City of El Reno and the inhabitants thereof that the provisions of this ordinance be put into full force and effect, an emergency is hereby declared to exist by reason whereof this ordinance shall take effect and be in full force from and after its passage as provided by law.
