Any person assisting, aiding, abetting or encouraging any minor under the age of 17 years to violate the provisions of §
155-1 hereof shall be guilty of a violation of this article, and when the minor is found violating the provisions of said §
155-1, a presumption shall arise that the parent or legal guardian having the care and custody of the said minor assisted, aided, abetted, and encouraged such minor in so violating said section.
The parent or guardian of the minor child shall be held responsible for the violation of §
155-1 or
155-2 by his/her child or ward.
As used in this article, the following terms shall have the
meanings indicated:
MINOR
Any juvenile under the age of 17 years.
PARENT
Includes the mother, father, legal guardian and any other
person having the care or custody of a minor or such other adult with
whom a minor may be found residing.
Whenever a minor shall be arrested or detained for an offense
committed within the Township of Grosse Ile, the parent of such minor
shall be immediately notified by the Police Department advising the
parent of such arrest or detention, the reason therefor, and his/her
responsibility under this article. A record of such notifications
shall be kept by the Grosse Ile Police Department.
It shall be unlawful for the parent of any minor to fail to
exercise reasonable parental control which results in the minor committing
any criminal act or violation of this Code or to allow or encourage
any minor to commit any criminal act or to become delinquent in accordance
with the Probate Code of the State of Michigan as it pertains to juveniles.
Failure to exercise reasonable parental control shall include
but not be limited to the following:
A. Knowingly permitting the minor to violate this article.
B. Knowingly permitting the minor to keep stolen property.
C. Knowingly permitting the minor to associate with known juvenile delinquents.
D. Knowingly permitting the minor to be absent without cause from regular
school sessions.
E. Knowingly permitting the minor to possess unlawful drugs and narcotics.
F. Knowingly permitting the minor to be without proper supervision in
the absence of the parents.
Penalties for violation of this article shall be punishable as provided in Chapter
1, General Provisions, §
1-3.
