A. 
This Article recognizes and repeats the chain of command of the Town of Niskayuna for action in emergencies and at other times when necessary, which said chain of command was adopted by Resolution No. 140 on March 18, 1969, upon request of the Civil Defense Organization of Schenectady County.
B. 
The Town officers named in said chain of command are hereby authorized to act pursuant to § 209-m of the General Municipal Law of the State of New York in the order of their listing; that is, Supervisor, Deputy Supervisor and Chairman of the Safety Committee. It is hereby determined for purposes of said § 209-m that these Town officers in order of listing qualify as the chief executive officer defined in said section.
It is further recognized that the Chief of Police may be confronted with an emergency situation without advance notice and may need immediate assistance at a time when none of the above-named Town officers is readily available.
Therefore, in the event of an occurrence as referred to in § 37-2 above, the Chief of Police of the Town of Niskayuna, whenever he deems that the public interest requires it, may request the chief executive officer of any other local government to detail, assign and make available for duty and use in the Town of Niskayuna any part of the forces, equipment and supplies of the Police Department, police force or parkway police force of the local government of which the request is made, and also under similar circumstances said Chief of Police is hereby authorized and empowered to grant police assistance from the Town of Niskayuna to any other local government when requested to do so by the chief executive officer of said other local government or by the Chief of Police of the other local government if the latter is delegated to make such request pursuant to the aforesaid § 209-m of the General Municipal Law.
