A. 
All structures containing housing facilities for the elderly or handicapped, as authorized by 12 U.S.C. § 1701(q) and defined by the federal regulations contained in 24 CFR 885, located within the Town of Niskayuna, having two or more stories and containing 49 or more dwelling units shall be required to have a passenger elevator.
B. 
Such passenger elevator shall meet or exceed the National Elevator Industry Inc., minimum passenger elevator requirements for the handicapped, accommodating an ambulance-type stretcher.
The Building Inspector of the Town of Niskayuna shall not issue a building permit, nor shall be issue a certificate of occupancy, for structures which do not comply with this Article.
A violation of this Article shall be enforceable and subject to the same penalties as provided in § 220-73 of Chapter 220, Zoning, of the Code of the Town of Niskayuna.
