As used in this chapter, the following terms shall have the meanings indicated:
RUBBISH
Paper, cardboard, excelsior, boxes or cartons, old clothes or rags, furniture, tires, leather or rubber scraps, waste or scrap material from building construction or renovation, tree limbs or branches, brush, grass clippings, trash, leaf and garden waste, or any other industrial or household waste.
No person shall kindle or maintain any bonfire or rubbish fire within the limits of the Borough of Palmerton.

No person shall install or use any furnace or heating apparatus that is not installed entirely within the building which it is heating. This includes freestanding furnaces and boilers where the heat is transported to other structures. This does not include barbecue pits, chimineas, smokers used for curing and flavoring foods, or similar outdoor recreational burning appliances.

The Borough of Palmerton Fire Chief, Chief of Police, Mayor, Health Officer or any other duly authorized agent, in that order of priority, shall have the power and duty to enforce the provisions of this chapter as well as the following exceptions:
A. 
Open fires may be set in the performance of an official duty of any public officer if the fire is necessary for:
(1) 
The prevention of a fire hazard which cannot be abated by other means.
(2) 
The protection of public health.
B. 
Open fires may be set with the approval of the authorized enforcement agent of this chapter, provided that:
(1) 
The purpose of such fire is for either an instructional or a communitywide activity; and
(2) 
No hazardous or other objectionable condition will be created by such burning.

Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punishable as provided in Chapter 1, General Provisions, Article II, § 1-17A, of the Code of the Borough of Palmerton.
