The purpose of this article is to enact local legislation in support of and as an adjunct to the New Jersey Smoke Free Air Act, N.J.S.A. 26:3D-55 et seq., by creating a smoke-free environment around municipal buildings within the Township of North Brunswick to further enhance the health, safety and welfare of its citizens and those employed at or visiting municipal buildings.
As used in this article, the following terms shall have the meanings indicated:
SMOKING
The burning of, inhaling from, exhaling the smoke from, or the possession of a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco or any other matter that can be smoked.
There is hereby established, around all municipal buildings located within the Township of North Brunswick, a twenty-foot smoke-free zone wherein the smoking of any form of tobacco product, either a cigarette, cigar or pipe, is strictly prohibited.
There shall be placed, at all public entrances and exits of municipal buildings, signs which shall be located so as to be clearly visible to the public and shall contain letters or a symbol which contrast in color with the sign indicating that smoking is prohibited within 20 feet of the building, citing this article. Such sign shall also indicate that any violators shall be subject to a fine.
It shall be a violation of this article to smoke anywhere within 20 feet of a municipal building within the Township of North Brunswick. Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be subject to a fine of not less than $100 for the first offense, $250 for the second offense and $500 for each subsequent offense.
